Default Prenup Agreement

Well, I am not sure if this belongs to this forum.

I am with a friend, for about 8 months now in Ontario. I need to have a prenuptial agreement set in place - house, car, property, everything that I have and had before meeting her to be mine. I also intend to open a new business - house based - and have this prenuptial agreement signed by both before I register the business.

Her stuff will be hers, and my stuff will be mine in case things do not work ok, but who knows what the future holds.

I am thinking of a prenuptial agreement. I am looking for ways in having this setup by someone who is qualified and can do it. I do not have much money, and I hear it is expensive to have it done.

I would like to know where, any recommendations, or anything that you suggest I should look into to have it done. I have also seen prenultial agreements that can be done over the web and printed and signed by both and still be legal...

You might want to get some legal advice from a good, honest lawyer before you spend your money on a prenup.

One of the guys I used to do business with had a prenup. The wife had an affair. They got divorced and the judge over-ruled the prenup. Apparently his prenup was about as good as a roll of toilet paper.

so unless you have lots of money, if the time comes, just work it out together or with a mediator because ...

if you think it is expensive to have a prenup done ...

it won't be anything compared to the lawyers fees that you will have to pay if your ex takes you to court. It doesn't matter if you have a prenup or not, just the lawyers fees on dealing with the pre-court and court issues, even if you win, on a messy split can easily be in the 10s of thousand of dollars ...

better to make a decision to make the relationship work and spend the money on making it work ...

You'll need a pre-nup done by an actual lawyer if you hope to have any validity to it.


As well, at least in Alberta, whatever you bring into the relationship is yours to bring out. It's only what's accumulated during marraige (Or common law) that is split.

Is the prenup because you will be in a common law relationship or are you getting married? (little confused)
