hi,

my friend got a ticket for going 60km in a 40km zone but the officer put down only 45km. the fine is around $25

I know the ticket won't take off any points. my question is, what should he do to avoid insurance increase?? will the insurance go up if he pays the fine or he needs to fight it off in court to avoid insurance increase??

If your friend committed the offence to begin with and the officer was good enough to lower it, I say pay the ticket, and IMO, he should consider himself lucky!

pretty damn nice of him to lower it. however insurance companies dont look at points. they look at a ticket as either a minor or major. this one being a minor. It probably wont affect your insurance since its your first ticket and its a low #. however keep in mind that if you just pay this ticket then if you were to get a 2nd one, it would put you in a bad position. also, if you fight it and the cop doesnt show it will get thrown out. however if the cop does show then you will be tried for the original amount, not the reduced one.however the cop would have to be a dick to show up for a 5 over ticket, unless he was doing a speed trap and all his tickets were on the same day, its a no brainer for him.

it would depend on who his insurer is...some companies will just remove the conviction free discount ...and then some don't even charge for just 1 minor..

pls be careful when offering insurance advice...some companies have a conviction free discount, which would be removed if there is 1 minor ticket and others will charge for 1 minor whereas some dont charge anything at all for 1 minor conviction.

Keep this in mind.

Those companies that do offer those 1st accident or first ticket waived...they don't tell you what happens if you get into a second accident or 2nd ticket. If you get a second accident or ticket, they deem that as 2 times.

e.g.

1st accident, insurance companies doesn't raise rates because they give you 1 accident claim without increase.

2nd accident, your rates jump sky high because they count that as your second accident, not 1.

Do you have a defense? Cuz if not there's nothing to fight is there, unless you're just hoping the cop doesn't show up. If the latter (and much to spf1971'a chagrin I'm sure...lol), I'd say show up, if the cop's there just plead guilty and pay it, if not, good day for you :)
