View Full Version : Rear ended on the 404 yesterday afternoon

So I was stopped on the 404 SB yesterday just before the 401 due to traffic, and then I look in my rear view mirror and see some guy not stopping. He then rearends me and pushes my car into the car in front of me. My car is now totalled, and we went to the CRC and reported everything, and everything was settled. (exchanging information, reporting accident, etc.)

The only problem now is that when I woke up this morning, I'm having whiplash neck pain. I cannot turn my head fully or look up and down fully. My neck is tight around the shoulders and bottom of neck. I am going to see my family physician in an hour, and my questions are:

1. What can I do about my neck?
2. Will this pain return say 5 years down the road, maybe 10?
3. Am I able to sue the guy for compensation for my neck?

sorry to hear that.....go see a doctor first and no you cant sue the person that hit you. That's why we have no fault insurance in Ontario.

You can get $$$ but you wont see any of it for at least 12-24 months.

I got a total of $25k entire process took about 2 years.....

Best to ask a medical professional instead of people on the internet.

3. Am I able to sue the guy for compensation for my neck?

You can sue for pain and suffering and for economic loss but there are conditions.

According to the supporters of insurers here at RFD, your treatment should be capped at $3500. If you take longer to heal, you are abnormal and the benefits should be terminated. If you want more, you are defrauding the insurer (as per supporters here in the other thread).

The AB benefits used to be capped at $100,000 for your future treatment... luckily it happened in the old system. If it happens in 6 months, you will not be eligible to all that benefits.

I'm pretty sure you are deemed not at fault... Call your insurance provider/adjuster and let them know that you are experiencing pain etc and they will transfer you to a benefits adjuster which will take care of you. They will prob give you a some options close by where you can get treatment and it will be covered by them.

I understand you are in pain at the moment but why are you wanting to sue someone so quick? It seems like you already decided that is your plan. See a doctor and find out the problem and the length of the pain first. It might not be serious and only last the week.

My pain and suffering miraculously went away after I got my last settlement cheque lol

And you wonder why some people on RFD want caps on these payouts?


Advice to the OP: see a doctor and take his recommendation.
I've been in an accident before and woken up the next day with a fair bit of pain and stiffness in the neck. It went away after a couple of days in my case, miraculously enough without having to even sue anyone!
