View Full Version : Does US Customs keep detailed records of minor incidents?

I am more than a little bit paranoid right now.

I got pulled into secondary inspection this morning for that I had thought was a very minor infraction, and now I am paranoid I will have a permanent record.

Showed a US customs a declaration saying NO to all quesitons from 11 to 14.

At the time, in my hand was a half eaten bagel as it was early and I was expecting the customs line to be longer.

The initial agent stamped me through but before I could hand in my form before security I got pulled over by an agent from secondary.

He took me in the room and made a point that I inaccurately filed out question 11(a) fruits, vegetables, plants, seeds, food, insects

I apologized and stated that it never crossed my mind that my breakfast was the type of thing contemplated as I would finished it before I got through security, and offered to just throw out the bagel.

The agent said, it does not matter if you throw it out or not, you brought it in the country, so you had to write then yes. He made me change my form, and then filed out some paperwork and asked me a few questions. How many times I went to the US this year, what exactly was on the bagel.

It took less than a minute, and I thought that the agent was just giving me a warning since it was not busy.

But now I am paranoid that the form that was filed out will go into my permanent record and that I will will be ineligible for nexus and be thrown into secondary for years to come based upon my half-eaten "bagel with cream cheese product".

Am I being paranoid or should I be concerned? If I am not wrong to be paranoid is there anything that can be done?

I think probably the only thing that concerns you might be for Nexus:

you have a recorded violation of customs, immigration or agriculture law

But I highly doubt they would deny you entry for such a minor infraction. It's not like you were importing meat or something.

But if the officer was in a bad mood, they certainly could have flagged the OP for more detailed inspections in the future, although I wouldn't expect a ban. It's going to pretty much all depend on the mood of the officer.

And if the OP has been flagged, no there isn't really anything that I aware of, that you can do.

my wife once had a minor infraction at the border when the driver refused to make a declaration...and they got pulled over and had to pay taxes/duty on the stuff that they bought.

I was worried about the nexus application that I recently filled out for her. I was not sure how I should answer the question refering to any previous infractions, since I did not know if she actually had a record or not from that incident. I decided to not take any chances and wrote about the border incident for that questions. I am happy to say that she had no problem getting the nexus card!

Don't be paranoid. Which Port of entry (border crossing) was this at ?
