View Full Version : Should vehicles (e.g. trucks) be held responsible for debris DAMAGING your car?!

Hey everyone,

Just asking an opinion. Obviously it's not Trucks fault, anymore than it is other cars who get rocks stuck in their tires and spit them out, but play with me a little..

More often than not, larger commercial vehicles like Trucks, Dump Trucks, construction vehicles, tend to spray, drop or leave little bits of debris fallling off their car and causing things liek stone chips to happen. Just an observation I've made over 7 years of mostly highway driving.

While any car can have debris thrown at it from anywhere, technically in the situation I described above, isn't there some sort of negligence there driving a vehicle on the highway without securing or cleaning it and then having that debris damage your vehicle?

What do you think? IN the winter as well, when vehicles have snow and ice flying off their car and hitting yours, should there be some responsibility?

Yes, and you can be pulled over and ticketed for that.

im pretty sure a dumptruck is held liable if they don't have that net over top of the truck.

Sometimes hard to prove.

I had a deflated tire occur from some small metal piece flying off a truck and cutting into my tire.

By the time i realized what happened and had to pull over, the truck was gone.

Had a small chunk of ice(or some hard snow) fly off the top of an 18 wheeler and hit the top of my windshield. Thankfully I stayed on course and didnt freak out. When I got home i inspected the car and there was no damage. I was lucky that day.

GO!

It is not whether there should be some responsibility, there IS responsibility.

If you don't clear snow/ice off your car or truck and it flies off and cracks a windshield, you are responsible for the damage. Btw, trucks will pull over if you pull ahead of them and point them off to the shoulder - I've seen it happen numerous times.

Yes, by law you have to secure your load. If it fell off and hit someone, you are responsible.

In reality, by the time damage is done, it is very difficult to prove the debris is from that vehicle. It is even more difficult to stop that vehicle.

That's the problem, how are you going to catch them and prove it? I suppose you could call the police (non emergency), but it'd be such a murky issue that unless it was extremely serious (debris crashing through windshield), they wouldn't be able to do much...

I think it's just one of those things that drivers have to be aware of and watch out for. If you're on the highway, don't stay right behind them, just pass them (safely).
