Hello,

I recently rented a living room to live in.

The conditions were, that there will be a drywall in place in one side of the room and the other side left open (Curtain).
We wrote this down on the lease agreement and has signed it.

I have just received a email from my landlord saying that instead of the conditions written on the lease, he put a door up and sealed the curtain side with drywall. Now he demands a higher rent amount.

Is there any legal action I can take? He didn't notify me of this change until now. (He has already done all the drywall and door stuff)

Thank you in advance.

How much was the rent you agreed to and how much is the rent now?

Call the Landlord and Tenant Board. Contact info here:

http://www.ltb.gov.on.ca/en/About_Us/STEL02_111278.html

If you already have a signed lease with an agreed upon rent, and it wasn't you that requested this change I don't think you can be forced to pay more rent because the landlord made what they consider to be an improvement. Your signed lease should be enforceable but call the number above and see what they advise.

The law states that a contract is created as soon as an offer is accepted. Once a contract is formed, NEITHER party acting alone can modify it or terminate it. Your landlord cannot unilaterally change the terms of the contract that you agreed to. If he does, you can sue him for the tort of breach of contract.
