Hello guys, and to make this a short; My company just lost a big contract, and they have told me to choose a date when I would like to leave with EI;
I have been working for this company full time since last year May...
Situation: Going to India for 2 months in October
Should I start the EI process before going to India or after I come back from India?
Which one is risky?
I just graduated from University; so, I should find a better paying job; so what is your guys feedback regarding this?

When should I apply for EI?
Be sure to apply as soon as you stop working even if you don’t have your Records of Employment. Delaying in filing your claim for benefits beyond 4 weeks after your last day of work may cause loss of benefits.
If your employers issue ROEs in paper format, you must request ROEs from all your employers who issued ROEs in paper format in the last 52 weeks. However, if your employer submits your ROE to Service Canada electronically, you do not need to request a paper copy of your ROE from your employer since we will receive it electronically from your employer. On the same day your employer submits it, you will be able to view and print copies of your ROE online using My Service Canada Account.

You will not get EI when you will be in India. Once you are back from your vaccation your EI will be paid to you again.

Its very safe to apply and get the process started before you go to India, the process requires a 2 week of wait period to be served by the applicant. However you can immediately hold your claim and visit where ever you have plans to visit and come back and resume your EI payments. Should you now apply before leaving and apply after there might be questions asked as to what took you longer to apply etc. applying before will save you the hassle, however remember that the clock for payment on the weeks that you will be eligible for receiving EI payments will continue while on hold. this means that if you are eligible for 40 weeks of EI and you were in India for the first 10 weeks then you will get 30 weeks of EI after you return. BEST Would be to call HRDC and ask them about this issue.

Don't assume you can begin getting it and continue to lie to them when filling out their weekly questionnaire. Human Resources Canada actually checks for passport useage and you will have to pay back funds + penalty calculated for the time you lied.

not quite... when you receive a claim you get X amount of weeks of entitlement based on the hours you worked in the previous year and you get 1 year to use that entitlement. Applying late is no big deal as the application will ask you why you are applying more than 4 weeks after you finished work. Just indicate you were on vacation as there is no crime as you are nit requesting benefits while you were away. Now the problem with applying late is that your qualifying period where they count the number of hours they base your claim on is 52 weeks prior to the week of your claim. So depending on when yuor employment started, you could have hours that are dropped out of your qualifying period. Example.. Mr X works from Jan 1-2008 to Dec 31-2008. He goes on vacation for 4 months after he finishes work and applies May 1 2009. EI will only use hours from May 1 2008 to April 30 2009 to calculate your claim, so the other hours you worked do not count. There are exceptions but that is the general rule.

Don't even cheat the system because we all pay for it. In order to get EI, you have to be able, willing and looking for work. If you know off-hand that you will be in India, don't even fraudulently take some money from our funds. Every working citizen of this country will not be happy.
And, yes, you will get caught and the penalties are severe, IMO.

Guys, not sure here, but aren't we focusing on the wrong thing? It doesn't sound as if the OP wants to get EI while *in* India. His company has offered to make his termination date be either before or after his return (presumably he would then be on unpaid leave in between - or would this be paid vacation).
It seems a perfectly legitimate question for him to arrange it to his advantage and ask for help. I'm not sure what the answer is - I would assume EI depends on both duration of employment and average weekly earnings - but let's not jump down his throat!
