View Full Version : Picket Line Question - Waste Transfer Station Blockade
flimbs
Jun 24th, 2009, 09:36 AM
Curious question: These picketers forming a blockade at the waste transfer stations. Are they legally allowed to prevent you from going inside to use these services (that you regularly pay for)?
I mean, if you simply beeline for the entrance, are they legally allowed to step in front of you, or forcibly block you off? (all this being on public property) The police are really useless in this matter, as they are partially part of the union, them being a union themselves.
They're only allowing one person in every 15 minutes, hand-carrying their garbage. But what makes them the legal authority on what you can or cannot do in a democratic society?

Another reason unions should be abolished.
Thank god we don't have this garbage (zing) here in Western Canada. You guys in Ontario are really overrun with (dis)organized labor...
And if you try to force your way thru they can't even touch you. Just have your garbage in one hand and a cell phone recording video in the other. If they touch you, you have the right to press charges on them.

Yea, these blockades are pointless. Older people are struggling to dump their garbage and others have medical conditions that may prevent them from doing so. It's also hot and humid so this has a negative effect on the respiratory system of seniors and others with health problems.
I'm not sure if it's illegal, but it may be unethical.

man if I were you guys I'd take like 10 people and wait outside till 5pm when they go home, and just follow them (to know where they live)
then post their addresses here, and I'd be first one to drive from hamilton to dump my garbage on their front yard...

If that were true, I'm surprised that more people haven't tried that tactic yet. Good idea on the video camera.
I just don't see how they should be "allowed" (by the police, authorities) to let people inside according to their schedule. They don't own the waste transfer station!!!!!!!!!!!!

but seriously someone from toronto should start this guys you have to start doing something to stop this...Toronto's image is ruined for god sakes.

I'm from Hamilton, If I lived in Toronto, i would've started a thread right now asking everyone to bring their garbage say Friday and meet somewhere close to union, and everyone to pay say $10 this way we can rent a truck, collect all the garbage ask those workers to let us in if not we all dump it in the entrance, if they call police, then we will tell them they didnt alow us in...and if the police thing is an issue, I'd call police right now and tell them about this and see what they say, if they say there will be no charges on us for dumping it at entrance, then we'll go ahead with it.

Except they don't go home at 5pm. I've driven past our transfer station at 9pm and they're still out there.

The only problem is that it depends on your pickup days. Our garbage pickup day was Monday so we've already had 2 weeks of garbage sitting in our garage and needless to say in this heat it's been cooking nicely.
If they allowed people to drop off their garbage without harassment then that's fine, but this whole only letting people in every 15 minutes and forcing them to walk is just stupid. Might have to go on Friday to dump the garbage and I'm already dreading it.

They're only allowing one person in every 15 minutes, hand-carrying their garbage. But what makes them the legal authority on what you can or cannot do in a democratic society?
On the radio 2 days ago, they invited a lawyer to talk specifically about this. Here's what he said:
The ppl on the picketline are legally allowed to "stop" you by talking to you. They are supposed to spend time to tell you their side of the story. Why they are picketing, etc....
They can spend as much time as they want, but their topic of conversation must be about this situation, their strike, their position, etc. They cannot repeat this speech over and over and over just to delay you.
After they run out of words to tell, they legally must move away and let you do whatever you were going to do. If not, they are now in violation. Hence, you can call the Police and Police will make them move away from you.
However, lawyer says, of course, no one is going to call the police on such matters, there will simply be too many occurances and there isn't enough Police for things like this.
The City is always supposed to provide mediators or someone that controls this situation. So the public are not held illegally. But, they don't provide such ppl, and don't want to aggrevate the striking ppl too much = violence may happen.
So, if the stikers are just walking around blocking your car and NOT talking to you and describing their story, then yes, they are illegally blocking you.
But again, there is no enforcement of this, so a lot of them will just not talk to you and some have said "okay, wait 2 minutes here and then we'll move". Kinda like my speech would have taken 2 minutes, so ....

Yes they can, there are police officers now situated at the waste transfer stations, but they're only there to monitor the situation, not to move ticketers out of the way. Do what a guy did yesturday, just slowly move your car and run them over if they get in the way (slowly), the guy who got ran over yesturday went to the hospital, but with no serious injury.

Ever forgot to put out your garbage one night? Well, pretend it happened again this week. All this hysteria is creating free publicity for the unions and thats exactly what they want. Ha ha ha! Are the drivers trying to dump their garbage Catholic?
Seriously, it's a legal strike. They are allowed to picket and delay the public from entering picketed facilities. If you absolutely need to drop your garbage off that badly (I have no idea why it must be done just NOW), then be prepared to wait in line. As for me, I'd rather invest in some nice plastic containers, and use this as a good excuse to start reducing my garbage. Take full advantage of the green bins for composting. When I started using this bins to the fullest, I found that I did went from emptying my garbage from the kitchen from every other day, to about once a week, because my garbage doesn't smell.
And I've always said that Toronto is the Whiny capital of Canada! We don't have it bad compared to most places in the world.
Most people here are so young, but they sound like grumpy old men.

You oughta learn from me. You paid your taxes and are entitled to garbage disposal. If jackasses want to keep you from doing that, drive your car right up to their picket line (at the garbage station), go slowly.. and honk at them till they move. Don't release the horn till you are close.
Make sure your doors and windows are closed :P
If you are as pissed off at unions as I am.. go and download the mosquito ringtone at 8khz. Burn it onto a CD. Buy yourself some ear plugs. Play that at max volume, you'll see them run away! If its noisy enough they might puke! Hahaha.

And what is it that you expect the cops will do? A hundred witnesses on the strikers side vs. you. :confused:Plus it could be argued that by advancing on the crowd with your car you were provoking them. And then add to the fact that the Police do NOT want to get into the media as siding against a big union or "peaceful demonstrators", over some dents on an irrational fools car.
Think these situations through people. The union has all the cards in their hand unless the government is willing to do a Reagan-esque move of firing everyone. WHICH THEY DO NOT. All that is happening is a bunch of posturing on both sides, the outcome is predetermined. So relax and ride it out.

I was in town over the weekend to get some stuff sorted out before I move back to Toronto in the fall. I had to go talk to someone at city hall and had no clue what was going on. I asked the guy If I could get in and he drew himself up like he was preparing to fight me and was a complete ass about it. I was only in town for the weekend and couldnt fill out any of my paperwork so this seriously inconvenienced me. Not to mention the strikers were heckling any body that walked by in a suit saying they were the reason this countrie's going to hell.
I understand they are trying to get a point across but being rude and obstructive isnt really helping their case or drawing sympathy from the public.

I hate unions...always have and always will...but I really have to agree with the people who are saying that Torontonians need to stop panicking. I was shocked when I watched the news on Monday night and saw that people had already started dumping garbage in public places. I asked myself why these people already had so many bags of garbage to throw out, and why they felt the need to dump it right away? I mean at the very worst, it would have only been 8 days worth of garbage, so why the need to freak out?
I live in Markham. We get our blue boxes and green bins collected every week, but our garbage is only collected every second week. On many occasions I have been a lazy bum and have decided to skip putting together my garbage so that I could go to bed instead. When this happens, I will have 4 weeks worth of garbage to put out the following garbage day, and I survive just fine. In fact, I could probably make do with monthly garbage collection since I usually only have two shopping bags worth of stuff to put out every two weeks anyways. (On a related note, I visit the Recycling Depot at Hwy 7 and Markham Road on a monthly basis to drop off recyclable styrofoam and plastic bags that aren't collected in our blue boxes right now).
I think that Torontonians need to learn to produce less waste and recycle more. That is probably one of the only good things to come out of this strike.

but I really have to agree with the people who are saying that Torontonians need to stop panicking. I was shocked when I watched the news on Monday night and saw that people had already started dumping garbage in public places. I asked myself why these people already had so many bags of garbage to throw out, and why they felt the need to dump it right away?
look at this picture. it was day 2 of the garbage strike and some people absolutely had to get rid of some old car tires, broken tv's, a wooden skid, a blanket, and what looks to be a tackle box. On day 2. the problem isn't the union. its us.

That is probably one of the only good things to come out of this strike.
i hate unions too.
i agree with what you are saying. The panic that these people are showing is not good for the city. We need to show the city that we can last all summer and are willing to do so to make the union cave and give up their sink days and sick bank.
ANd then we need to produce less garbage so less garbage men are needed and watch some of these clowns, unskilled clowns get laid off.

Wow, lot's of tough talk from you. I love your posting history. You are an angry little guy, eh?
I hate to break it to you, but you are suggesting breaking the law and assault. The picketers do have a right to delay you from entering picketed areas. I may not agree with what the union is asking for, but they still have the right to strike, if they believe in it.

I live northeast of Toronto so I'm not having to deal with this garbage, and I too hate unions but I also agree that people need to take this time to learn how to reduce garbage. I have a lot of recyclable stuff that goes out each week. One week it's paper etc. and the next week it's plastic, containers etc. Our garbage is picked up each week (by non city workers......it's all contracted) and we don't have composting here. In all honesty, the size of my garbage back is about the size of a typical grocery bag, and it's not full. I stopped buying green garbage bags as I can't fill one.
Yes, it's an inconvenience, and yes, these fools striking at a time when the economy is in a mess is ridiculous. They should be thankful to have a job. But people need to use the brain their maker gave them and stop making a big mess when it's not necessary. REDUCE your garbage. It can be done.
Oh, and far as what some lawyer had said several posts back, it may be the right of the picketers to "tell their story" but it should be the right of the taxpayer to say "no thanks, I'm not interested in listening to you, excuse me, you're blocking my way" and that should be that. I don't want to have to listen to their whining and that is my right, is it not?

Went the Scarborough transfer station today around 1pm. I must say, I don't know if it was because there was an officer across the road or they decided on how they wanted to act, but was actually not bad. You couldn't drive up, so we parked on the road close by and walked our bags of garage (2) up to the gate. One person asked if we knew why they were striking and I said yes. They just left and talked to other people. Got up to the gate and 2 men there said just to place the bags on the ground. Once I did they picked up the bags and threw them into the back of a garbage truck. Went back to the car and drove off. Much better than the last strike and not anything near what I've seen on the news.
@st7860: we have the robo arms now.

it is not about proving a point...it is about breaking the union and making them lose their sick days and sick day bank.
if they are legislated back to work, arbitration will not take away their benefits that they must lose. we have to tough it out, make them suffer and eventually give up. we need to dig in an destroy them. if we don't, they will continue to eat the city budget until we have 2 pools to share in the city.
that said, dumping garbage on their heads sounds good.

I was at Duffering station on Friday around 1pm. We couldn't drive in. We just parked the car and carried the garbage inside.
Some of the guys (people on strike) actually offered to help to carry the garbage for us (two women). That was nice of them and I definately did not expect that.
Everything was done in 10 mins. Very peaceful process.

Despite what most people believe, the union workers want to work. They aren't crazy maniacs who are hellbent on destroying the city. They are just everyday joe's who want to provide for their families.

I think parking on the side and then walking the garbage in is the fastest way to dump it. Did that last week at the Markham/Sheppard location. Saw people waiting a long time to drive in.
Anyone been to the 24H ones? Do they have picketers all night round?

I was driving by the Markham/Sheppard transfer last night around 11-ish and there were a few of picketers at the exit facing on Markham Rd.

I figured it was both - garbage folks lift/take the garbage bins to the trucks, and the truck lifts the bins and empties them into it's holding thing. 'Least that's what it seems like around my area.
