**UPDATE**
Rather than deal with this myself, I have no more time for games with 19 year old punks who think they're gangbangers, so here is my proposition. If anyone out there knows exactly where this individual lives or what school he goes to or where he can be found regularly, please PM me with his name, e-mail address, etc. If any of this information leads to him being found, I can offer a small reward. If anyone wants to do anything about this for me, I can offer a bigger reward. Thanks.
For anyone dealing with this individual, please use extreme caution. I purchased an HTC Touch Pro from him and not only have I had problems since day 1 with it which he refused to solve, he did not give me the charger and case which came with it.

This is item I purchased from him. The day I bought it from him, the very same night I got home I was already having problems with the phone and contacted him immediately to arrange a return. I was having sound issues with the phone and now the phone does not work at all. The sound was intermittent to begin with and it was not something I would have been able to notice when I purchsed the item from him.
He says he no longer had the money to return to me and now he is online selling further items. To date, he has read my messages, has not responded, has failed to send me items which are owing to me, and has done nothing short of rip me off.
I now have a functioning phone with absolutely no sound, no wall charger, and no repsponses from him.
I can post all of the messages I have sent to him, but otherwise I have no way in finding him now. I have his phone number as well and know he lives in the Mavis/401 area. I have also left him negative feedback already to which he sent a PM saying he wouldn't help at all now that I left it.
If anyone can help, please do, an address of the individual or anything would be greatly appreciated.

You shouldn't have taken the phone in the first place if he didn't give you the charger, how did you expect to charge the battery? Regardless, he owes you a refund for the defective product or at least give you the charger and the case.

I just have a few questions about this deal. The phone in the post says 8/10 condition but does not make any reference to a missing case & charger.
Was this dicussed in person, or in PM's that the case and charger do not come with it?
Did you inspect the box/packaging that the phone came in to see if the case and charger were there?
--IMO, the information here appears to me either; 1. there was no packaging and he just handed you the phone or 2. you did not check to see what was in the box, or 3. prehaps you did and saw the missing charger/case and paid anyway?
In the case of 1) if you paid, you knew there was no charger/case and do not have a valid complaint (on the missing charger/case).
2) If due diligance was not done, it is hard to say. On one hand, if you are buying a phone you expect a charger to come with it unless it is mentioned by the seller that it does not. That being said, the buyer should inspect the package to see what is included if it makes no mention in the post/in person what comes with it before the money is handed over. In Desijatt's post he makes no mention that it comes with anything, but he also makes no mention that it is missing anything. Buyers should be asking in this case what comes with the phone if it is not listed.
3) Well if this is the case, then you accepted the deal even once you realized the missing case/charger and obviously there is no fault on Desijatt's part (only as it relates to the charger/case).
Were any of the sound issues discussed previous to the meeting or when you met up?
The sound was intermittent to begin with and it was not something I would have been able to notice when I purchsed the item from him.
I gather from this that the phone was not tested when you met up?
From the information you provided it appears to me that Desijatt should refund your money. The fact that he says he can not refund your money because he does not have the money and not for the reason that he does not believe he sold you a faulty product leads me to believe that he knew what he was selling you and has no intention of rectifying it after it was sold.
On the negative feedback, it does sound like it is deserved but sometimes it is best to wait to see if a deal can be worked out before one is left, if not in PM's maybe over the scammer/warning section.
I would post his name/email on here as well if he is not willing to fix the situation so others can be weary of him.

Thank you for the information JAC, it’s greatly appreciated, and yes, one of the numbers you posted is definitely his number. It shoudn’t be too hard for me to find out where he lives since I can find his car in the driveway, I know the general area he lives around. He was as a teenager and I think I will definitely find a way to deal with this if I do not hear from him soon.
Phomp – as for the missing case and charger, the phone came with the boxes and everything, we just looked through it and he even said the charger was inside. Since the phone uses a mini-usb cable (mind you it was darker outside at the time), it looked as though the charger was in the box so we didn’t pay much attention. And in fact, we have MULTIPLE PM’s going back and forth in which he even acknowledges that he would in fact meet up or ship me the items which he forgot to provide me with. I provided an address after he failed to contact me to meet up many times.
I wouldn’t even have minded if the phone didn’t have the case but he EXPLICITLY stated in a PM that he even forgot to give me that, so I am not the one making false accusations. The package was in fact inspected, but he was in a “rush” as his father was the one who drove him. And to be honest, how often does anyone think they were getting ripped off getting a ride from their dad.
The sound issue was never discussed at all prior to the deal, and I checked to see if the phone was functioning properly when we met up. But as I said, the problem was intermittent and only after usage for an extended period of time did I notice the sound was flickering and then stopped altogether. I found a way to make the sound function conditionally by pressing on the back battery cover, and sometimes that would make the sound work for an hour or so, so my best guess would be that he “fixed” it to that condition and sold it to me. Now the sound does not work altogether.
I left the negative feedback only AFTER many PM’s and I even warned him many times that I would be leaving the feedback if he did not fix the situation. So it was well warranted given the fact that he has yet to rectify the problem.
I will in fact continue to pursue this problem and he has yet to respond to any of my recent PM’s. At this point I don’t believe he would be willing to give my money back, so I am going to try my best to find his home and we’ll go from there. =)
Does anyone else have any suggestions? Sorry for the long post guys, I appreciate the help so far.

just for you guys to see, this is just one of the many messages I have going back and forth with him. He acknowledges in this one that he would ship me the items and provide tracking. I have notified him to the creation of this thread as well.

first off i'd like to start by saying leaving the charger and case out of the box was an honest mistake they got left at home
Now there where no problems with the phone prior to me posting my listing. If there where i simply would have sent it back to vodafone as i have all the documents to prove that this phone is under contract in the UK. Lastly when we met i did not stop him from checking everything, for god sakes i even came to the meeting spot with my dad as my car was unavailable @ the current time.
There after I waited until the next day because the buyer said he wanted his money back, later on that day he changed his mind and said he would stick with it, i then went ahead and purchased what i had to, Then 2 days after the sale he tells me he's having problems with it and he doesn't have the time for it and he wants his money back!

i've had enough of this buddy, There where no problems with the phone when i sold it to you, if there where i would have sent it back to england you fool because i have a contract there with the phone, that's how it was purchased so still covered by vodafone's warranty your making threats about finding out where i live and coming to my house you better know who your dealing with
as for your charger and case, there in my hand right now and quite honestly the way your treating this situation we shall see if you ever see them
FYI guys, this is the response I just received from this member. Not only is he threatening, he still refuses to cooperate properly. Not once did anyone make a threat towards this 19 year old child, but he even tries to defend himself.
He also clearly states that if there was a problem he would have sent it back to England. Now let me quote him directly that I said I would stick with it. The very same night I asked for my money back, and he said to stick with it as it is a ROM issue with the phone. Now in my saying that the sound was intermittent, the problem corrected itself the next morning and I thought it would be okay. After the sound was not working again, I immediately contacted the seller and asked for my money back again, to which he responded that he no longer had the money.
I have made many attempts already to ask for my money back, and when I no longer wanted to deal with this issue, I just requested he send me my items and I would deal with the loss. However, after all of this and this hostile reply and his childish response above mine, I still have yet to receive a thing or a response even, and he comes onto this message board trying to defend himself.
To Desijatt - if the item you sold me in question is still under warranty, why not just return my money and deal with the warranty issue yourself, get the phone fixed, and try finding another buyer. I told you there were issues fom the first night and not once did you even offer to get the phone fixed under warranty. You are the one making threats and I merely asked for help from other forum members in dealing with your behaviour.
You have yet to rectify the situation and I have no problems posting other hostile messages I have received from you.

I had problems with this seller too, we had arranged a deal for a trade off for PC parts, in which he made me purchase a $350 motherboard and then bailed out for the trade.
The kid did not reply my pms, e-mails, or cell phone calls. I could see he was reading them too, and he then blocked me from MSN.

FYI guys, he's responding again after I brought this matter to everyone's attention and here are the responses below:
me - listen up bud, you're the one making threats, and I'm not going to stoop to your level and throw childish insults at each other. You have every chance and right in the world to defend yourself, but to date you have made nothing but empty promises and the fact remains I have a defective product and you have done nothing to help. I can take these threats quite seriously and will consider filing a police report if your threats become more serious.
If you really think I'm threatening a 19 year old, you should grow up a little bit, I don't care if you think you're some kind of gangbanger or anything, i'm just trying to solve my problem. You're more than welcome to post this in the forum and as a matter of fact, I will gladly post it for you.

Me - I would like my money back, I will return the phone to you and you can do whatever you want with it. If you maintain there isn't a problem you can deal with this yourself.

Me - That doesn't solve my problem. The sound does not work at all on the phone now, you purchased the phone, therefore you should be the one sending it back for warranty. My obligation as a buyer was to buy a working phone and yours as a seller to sell me a working item. None of these things happened.
You can find a way to get the money back. If you think the phone was working fine and warranty will fix it, you can recooperate the money in time. This is your obligation as a seller. I am also posting this reply in the forum.

saying that the phone has no sound is not my problem the sale happened more than a week ago, and when we did the sale i took my sim card out of the phone i was using the phone PERFECTLY fine up until the sale, other than the fact that i told you the rom needed to be changed

And I have been trying to contact you for weeks now, what don't you understand about this? How can you even use that as an excuse?
If the phone was working perfectly fine, why is it that I have had problems from the first night? It is very easy for you to say that now but the fact remains I have been contacting you about problems with the phone from the first night.
You can plead innocence all you want, but this is much after the fact. I have been contacting you for weeks, and I haven't had the time to follow up on it again until now, did you think the problem would magically go away?
I want my money back, you can fix the phone yourself under your warranty. I don't even know if the phone is under warranty properly so for all I know, you can be saying that now and then once I call and they tell me the warranty is not valid, we will be going through this all over again.

Those are his current threads he has going, if he claims to have no money to return to me, what about all of these items he is selling? Desijatt clearly has the money to return to me and has now disappeared again, not answering PM's, and has yet to respond again. He was last online at 3:50 so I know he received the message i sent prior to this one at 3:35.
Is there anyway to have this guy banned or anything from RFD? I hate to say it guys, but his actions has guilt written all over him so I have proven that I did not make a false accusation.

When you ask him for a deal, did you clearly ask him if the phone works perfect with no issue what so ever.

Here is the summary of this case after hearing both side's story.
OP claimed that the unit is defective and not working, Desjjatt claim that the unit is working prior the sale and he let the buyer to test it during the meet up. It is hard for us to judge rather the unit break before or after the transaction.
Desjatt offered to ship the missing accessories to the buyer at no cost. Advised seller to do so and resolve it ASAP.
Case closed for now

UPDATES: July 22.
Desjatt agreed to ship back the missing items to the buyer chow_mein, I gave him enough time and even instruction to how to ship back the items back to the buyer. A tracking number and a proof of shipment as been ask for, but never received.
Desjatt has been temporay banned now until chow_mein received his items or when a valid tracking number or a proof of shipment is given by dejsatt.
