Hey guys,
A few weeks ago I posted about a STAY app I filed for. I received no response or correspondence from: prosecutor, attorney generals (ON and CDN), and/or the court I served them to.
Right now, the stay application is my 1st strategy to have my speeding ticket quashed. EVen though I feel I have a rock solid argument for the stay, and very similar arguments from similar cases, I'm not 100% confident in this application and am curious to my next steps.
What can I do afterwards if the JP denies my application for stay? I'm filing against Section 7 and 11a of the charter so I still need to view the information I requested in order to prepare proper defense.
Is worse case scenario a conviction? Or am I entitled to adjournment until I have the information I requested?
Lastly, the location of the court is remote (4+ hours away), can I tell the JP that my actions are short of applying for costs and that the stonewalling of the prosecutor is costing me a lot of money to file motions?
