View Full Version : Dealer won't give me my deposit back

A month ago I was interested in purchasing the Toyota Corolla, so I put in a $500 deposit, which they said and stressed was 100% refundable.
Then I cancelled my order b/c I got a better deal at Hyundai.
Now I'm going through the pain of getting my deposit back. Called my sales person about 3 times over the past moth, but as he seems like a total a$$hole I called his manager twice and even went to the dealership myself.
They got my CC info 3 times now and still no refund.
What can I do? Is there anywhere I can complain about this. This is really starting to pi$$ me off.
Is there a website where you can review a dealer experience so I can post my horrible experience with these crooks?
They always say they cannot find my file so they don't know if the refund was done already or not. What a bunch of whimps.
What do you guys suggest I do?

If its on your CC, advised your credit card a charge back

If you paid with your CC, call your CC company and have them do a charge back.

OK, I will wait one more day b/c they said they will do a refund on Saturday, so it might take up to 4 business day before it shows up. If the refund is not on my CC by tommorrow, I'm calling Visa.

Chargeback won't go through.

There was something on CTV just last night about this. Where two guys bought some service and then decided they didn't want it, so they asked for a refund. The company gave them the run around, so they went to their CC to do a chargeback, but when the CC talked to the company, the company told them they refunded their money already, so chargeback was denied.

This will likely happen to you as well.

Is your dealer Don Valley North? The have a guy here from Don Valley North Toyota running one of the threads in this forum... you can complain to him directly.

Yes, I did sign something. But it was not the bill of sale, only some kind of and offer or something. They didn't even give me a copy.
I got a receipt for my deposit that says 100% refundable.

I would assume the company has to provide a receipt for the refund? OP should still call Visa and ask for a chargeback.

Agreed. Credit card companies will often accept submissions of evidence from you as a basis for the chargeback.

Talk to the president. Tell him the scenario. Be persistent.

Worst case, get it back in credit and have them do your oil changes with genuine Hyundai filters.

In Ontario we have Omvic (Ontario motor vehicle industry councel) they are the people that handle these type of problems, i'm sure in Calgary there is the same type of system in place ,do a google search I'm sure you'll find them..

It sounds like you didn't put a deposit down - it sounds like you BOUGHT A CAR.

Putting a deposit down would be like "Here's $500, hold the black car for me on the lot"

But you sound like you ORDERED A CUSTOM car, and the dealership ordered it for you. You even mention you signed a "bill of sale". Why would you sign a "bill of sale" if you didn't buy a car?

Then you found a better deal at another lot and you want to cancel your bill of sale.

Just walk into the dealership and explain your situation to every customer you can see. Show them the receipt that says "100% refundable".

The deposit could be refundable WHEN he takes possession of the car (ie: it's a deposit, not a cashdown on the car). That was the case when I bought my audi, when I took possession the dealer refunded the 500$ deposit so I could finance the entire car (good %). If he signed a bill of sale, he's screwed.

If he has a receipt that states that the deposit is refundable, it's very likely he will get his money back. The danger when signing a document and then providing a deposit is that a contract is formed. The buyer offers what is legally called "consideration" and the seller agrees to provide the car at a stated price and time frame. The cash obligates both sides to honour the contract. For example, if a dealer realizes too late that the car has a higher cost than first thought, to bad for it. Most times, it works in their favour. Dealers can play hardball on this. It's the reason they ask for a credit card when negotiating starts; it creates leverage against you. From practice though, unless the dealer has incurred real expenses, e.g. transfered a car, they will typically return the deposit. You just have to be insistent.

It was Heninger Toyota on MacLeod Tr. Personally if I ever decide to buy a Toyota, I will most definitely deal with someone else.

No I did not buy a custom car, the car was sitting at their parking lot. He showed us the car himself. The salesman told me I can change my mind no problem, I can just call in and ask for a refund over the phone. The deposit was done just to have them hold the car for me, at least from my understanding.
Even the sales manager when I came there in person did not say anything about me not being able to get the deposit back, he just couldn't find the file, which I find ridiculous. They couldn't even figure out who filled out the deposit receipt.

He'll get sued for slander and libel, or a defamation of character suit. Just be persistent, and use BAD words :D.

They can sue, but that would be counterproductive because it would be all over the press. Also, truth is an absolute defense in these cases.

Sounds like the issue is with the idiotic sales guy then.. make sure to keep copies of your receipt in case it gets lost, it seems like the only proof. You should also have asked for a copy of the form you signed but that, I guess you'll know for next time.
