I got scammed by the RFD user "battlegalactic". Currently involved in the Paypal dispute process.

Detail as follow:

1. The user "battlegalactic" listed 3G iPhone 16GB for sale: http://www.redflagdeals.com/forums/showthread.php?t=740338

2. May 20: I message the seller on May 20th and we settled with a price of $430 including shipping. I requested the seller to send me a paypal invoice.

3. May 20: Seller sent me a paypal invoice for SERVICE. (screen shot: http://i153.photobucket.com/albums/s215/e-bay-clearance/1-69.jpg) which I cancelled and requested the seller to send me another invoice for GOODS.

4. May 20: Seller sent me a paypal invoice for GOOD (screen shot: http://i153.photobucket.com/albums/s215/e-bay-clearance/2-57.jpg) which I paid for.

5. May 20: I requested the seller to provide me tracking on May 21 after it is shipped.

6. May 21: With no tracking information, I PM the seller again for the tracking that evening, his reply is: “yeah, i sent it in the morning. tracking # is in my jeep and it's really late right now. I'll pm you tracking in the morning.” (screen shot: http://i153.photobucket.com/albums/s215/e-bay-clearance/3-49.jpg)

7. May 22: After I failed to receive the tracking again in the morning, I opened a Paypal dispute for non-receipt to prevent the seller from withdrawing money into his back account in case the seller is fraudulent.

8. May 22: Later in the afternoon, the seller replied: “oh sorry yea i got distracted, was at school and wasn't going to check msgs until i got home. i sent it and got the receipt # 7218809004913474 Sorry for the delays. I think you can check tracking on canadapost.ca.” (screen shot: http://i153.photobucket.com/albums/s215/e-bay-clearance/4-37.jpg)

9. May 24: Seller escaated the Paypal dispute into a claim. In his comment, he said: “I sold this buyer digital items such as how to unlock the iphone 3G with the newest firmware and sent to the buyer's E-mail address. This item I sold is an intangible item, and I already sent the information to the buyer's paypal address. Paypal, please look into this. Thank you very much.? 10. May 24: I PMed the seller, but he has stopped replying.

Hmm, thats a tricky one. Did you enter the tracking number the seller sent you into the claim? If the seller claims that it was an program to unlock the iPhone 3g, there wouldve been no need to have a tracking number. Paypal then would probably question as to why there claims to be a tracking number. The seller could've posted it as a service but you denied it. The best thing to do now is not to wait, but to contact paypal and explain the situation. The funds in the sellers account are most likely locked and will wait for the seller to respond.

If you paid with a credit card, you could wait a month and be able to do a chargeback.

OP you will not get your money back, the guy will be banned from RFD and he will create abother aco****, in the history of visiting this forum nobody that has gotten scammed ended up getting his money back.

But you have a little hope.... the PayPal dispute, but you ought to know that PayPal doesn't give a hoot about anybody's money and neither they will for you.

I'd leave a message pointing out that the seller is clearly lying about the intangible item when he provided a tracking number.

And why would unlocking cost $430 CAD? I am sure the Paypal employees know better than this.

Update: Paypal decided on my favor but they were unable to recover any fund from the seller's account. I guess I'll have to do a chargeback since PART of the payment was made with credit card.

Gd Job using your credit card rather then Bank Account.

If Paypal won't get the money back then they just have to take a lose when the cr3dit card companies refuses to give them the funds(Chargeback). =)

I called Visa, was told I have to give Paypal 30 days so they can try to sort it out. If they are unable to recover my money after 30 days, I can call in to do a chargeback.

Well, I still lost about $73 but I guess I am lucky since the largest sum of the partial payment was made via credit card.

paypal wont do anything for you.

your credit card will protect you.

NEVER EVER fund PayPal with a bank account.

side note: my frined sold an item. the other guy tried to scam him. PP ruled in my friends favor, gave friend the $.

scammer does chargeback on his CC and paypal takes $ back form my friend.

friend has already spent some of the $, PP locks his account till they get all the $ back that the scammer charged back.

Yeah Paypal is shite, I boycotted them years ago when I was scammed and they did jack all to help me luckily I got a partial refund when I did a charge-back with my CC company and afterwards Paypal sent me an angry notice that I should have contacted them first before filing a charge-back, LOL! Ironic because I did file a dispute with them first.
