Hi, I got a parking ticket at a condo in Richmond Hill, Ontario. I got the ticket because I forgot to get an overnight parking permit.
My question is, I heard that it is not mandatory to pay parking tickets in private owed properties; is this true?
Another myth I heard is that Toronto is running low in capacity to handle parking tickets; so if you request for a trial, they will not give you a trial and the ticket is waived.
So, should I:
1) pay the ticket
2) request for trial
3) do nothing

If its given by the city then it will go on your plate..I would fight it..what do you lose? Worse thing would be that you would have to pay..

Many municipalities have parking by-laws to regulate on private property.
Was this issued by the Town of Richmond Hill?
Another myth I heard is that Toronto is running low in capacity to handle parking tickets; so if you request for a trial, they will not give you a trial and the ticket is waived.
Richmond Hill is not Toronto, and York Region courts may not be as backed up as significantly as Toronto courts.

welcome to RFD.
Please try to use the search function as it can prove to be one of your best friends here on RFD.....especially on topics that have been discussed, debated and argued on times without number.
To answer your questions,
private parking tickets are illegal in toronto. the government-issued ticket(usually the ugly yellow ones) are the only legal tickets in toronto.
now is it "mandatory" to pay it as u ask? Thats a subjective thing which depends on u and your social standards as an individual of this society. A few people on here who like to play "God" on these forums and act like they are "holier than thou" might nag you and ask you to be a man and take responsibility for your action or whatnot. While i don't support parking illegally or whatnot and while i don't think its socially responsible to park anywhere u shouldn't, i personally would still not pay the ticket.
But in regards to the legal system, here is what is going to happen if u don't pay it: they will/might eventually send it to collections (if its a large ammount) and u will have the collection agent hounding u down with letters. Many fear that this will result into a bad record on their credit reoprt but i guarantee u that it will NEVER show up on your credit file.
I would call the collection agency and tell them u want to talk to a supervisor and then let them know they need to stop harrassing u with their letters or calls otherwise u will proceed with legal actions. More than likely , they will back off and send the case back to the owner(the parking people).
So its up to u if u want to pay it or not or go through all that or not.
To your second question, the answer is yes. It's not a myth but rather a fact that the Toronto court system is "clogged" and does not have the capacity to handle "every" parking ticket and so therefore if you request a trial, chances are that they throw the out and u will be free of it. However, you should know that this is not a 100% bulletproof guarantee against tickets. Most will get thrown out and some will get court dates. I dont know how they go about deciding whose or which ticket to throw out and whose to pursue......maybe they play rock, paper scissors behind closed doors :D
Again, as in the first situation, its up to u if u want to pay it or not or go through all the hassle of filing a court date and waiting months and this and that (of which, u might still have to pay it at the end)
Me personally, i file and fight each and every ticket i have recieved and will continue to do so for everyone "i hope not to get but i get" in the future.
........also make sure that the bypass law works in richmond hill. Many people forget GTA(mississauga, richmond hill, brampton, vaughan) and Toronto are totally different cities with different laws.
