View Full Version : when to take action on someone i traded with?

Hi all,

I recently purchased a rockband drumset BNIB from an individual on this site for $30... told it was BNIB so i checked up on the bestbuy / futureshop website to see what the drumset kit included and it included all the drums, pedal and drum sticks..

so we decide to meet up and its not until i arrive at the meeting place and meet with the person that I am then told it was an RMA drum set that has never been opened.. i believe this should have been told to me over the numerous PM's we had but it was not... i still accepted it as I believed it would include everything that the regular drumset kit includes...

i did not open the prodcut there (i guess that was my mistake) but when i opened it the next day, it turns out that there was no drum pedal and no drumsticks...

i let the individual know this and how he said BNIB but it was RMA.. he said i accepted RMA so i said ok thats fine.. then i said how i was going to purchase the drumset kit for 40+ tax at bestbuy (when they had that online sale) but i thought.. hey.. if i can get it for 30, im saving myself 15 dollars...but then he accused me of being stupid to believe his set came with the drumsticks.. even tho all of the BNIB drumset kits come with the sticks...after some discussion, he left me a PM saying he will try and work out the issue for the pedal and even supply me with drumsticks... i geniunely think this guy is a good guy but felt kind of scammed that this box didnt include the pedal or the drumsticks and also him telling me why i would think it WOULD include the sticks for 30.. obviously i would think so when u do BNIB drumset kit...

anyways.. the last PM i received from him was on October 17th (5 days ago) saying he would look into it. I have sent two PM's to him after just asking if he can give me an update about the pedal and drumsticks as I am getting rockband 2 for ps3 and i want to have a drumset to play it.... have not heard back from him and I have checked and he has been on rfd both times after my PM...

i was just curious if you guys think ive left enough time for him to get back to me regarding this issue (5 days) without hearing from him... i dont like to complain about items and it isnt such a big purchase.. but this 30 dollars could be used for a new guitar hero world tour bundle or drumset when that comes out...

should i take action here now or still wait?

to the person i dealt with, sorry i had to post on here but i really feel that this has been a while and dont know what else to do since you havent given me an update.

When the RMA condition of the product you're about to purchase was disclosed to you prior to you making the deal...you should have walk out and keep your money...that should have been an indication to you that there is a good chance the product might be defective etc...I don't think if you got scam, I bet you, you had a bad feeling about it but decided to take risk since you are already at the meeting place with the seller?

Lesson learn I guess bro:D

if the product is not as describe on the seller's thread...walk away from the deal, safer that way.

ya i guess...

but i think its a scam if the person is gonna say BNIB... didnt say anything about RMA before hand.. and i asked.. this is the official rockband drumset kit right? and was told yes..

ya i should have declined right there but I was told the RMA would include everything that the regular rockband drum set comes with... at first kudos for him replying and trying to make things right saying he was going to figure out why there was no pedal and would get me some drum sticks... but yet i still havent heard back from him in 6 days although he clearly coems on this site atleast once a day..

has it been long enough now to leave negative feedback and talk to an admin about this person?

yep...he definitely lied to you about the condition fo the product...if he stop communicating with you complete...then it means that he has no intention of resolving the issue with you...does it has enough grounds for negative feedback?...maybe???...I guess it's better as you mention to consult the matter with mod first.

yup ive given him a week now with him checking rfd atleast twice a day... but never replying to me... i am going to leave a negative feedback and also make another post here with his username and let the moderators know to see if its possible to get him banned (although i doubt the moderators will)...but i can try..

get him banned for what, for your mistake of buying maybe you should of read it all threw the lines first next time before purchasing anything else!

maybe its just mis communication some how maybe he is a bad seller but still there is no grounds to call him a scammer is it?

selling me a product that has 2 missing parts.. and then deciding never to reply back to me in 9 days and just taking my money and getting away with it... thats not scamming me? how is it not?

going around taking ppls money and selling them products that do not include everything that is suppose to be there.. id say thats a scammer..

Sorry just my opinion but:

1. You had a chance to examine the item prior to purchase and didn't.
Thats your own fault.

2. For all the time/money/heartache involved you're sorry you never bought
a new product for just $15 more.

No sense whining here, post your negative feedback and move on.

i do agree that i should have opened the product there... but question for you guys? if you were to buy a sealed game from someone, would u open the sealed product right there??

i was told BNIB so thats what i assumed... guess i was wrong..

however the guy has mad efforts to meet up so that i can return the items to him (suppose to meet up tomorrow but didnt receive the confirmation for it yet)

so ill let everyone know how it goes and then the thread can be deleted.. thanks for your input

If it's been advertised as BNIB, then it should be. The minute you were told it was RMA, you should've backed out of the deal. A bit of fault on both parties here.

Your kinda contradicting your thoughts here...

Day 1. You were told your buying BNIB
Day 2. (meetup day). He tells you "it was a RMA drum set that has never been opened". Therefore whatever is included in the RMA drum set is included isnt it? (not sure but thats my opinion)

Also I had a similar experiance buying a Blackberry Komet. Talked with this guy for 2weeks or so, as he was selling mass amount of blackberries with no box. He said all are brand new.. I meet up with the guy, i see a hairline scratch, but the fact is, its scratched. so its not brand new. Told him to drop the price as its not brand new. Since he refused, I left.

hey guys.. thanks for being concerned and want to see how it turned out...

the guy stopped replying to me after the end of november after i tried many times to meet up...he would be like... "ok ill get back to you by wednesday"..then not get back.. then id try again and he would be like.. "ok friday for sure" then never get back to me... been a while.. gonna look to leave negative feedback now... i know its been months since the transaction but i guess its the best i can do...

once i found out it was RMA.. assumed it should have what comes with the regular drumset.. ie a drum pedal and drumsticks... got neither of them and got screwed by this guy.. gonna see what action i can take now that i have given him a long time and he has just ignored me now..

i know its not a lot of money and now i cant even try to sell the parts since the whole set goes for like 60-70 brand new these days..

but if anyone that has rockband drum sets and wnats like backup pads and stand for cheap.. let me know..

I was gonna buy from this guy as well before you did but I got lazy and stopped msg about it.

he had told me it was RMA but that everything for the drumset was included.

You were clearly mislead and should keep PMing him especially if he still comes on here.

He said BNIB but RMA. He failed to mention that an RMA box does not include drumsticks and/or whatever else is missing. You deserve the missing items as well. By saying BNIB (even though RMA), I would say its safe to assume that everything should be included.

Good luck and leave him negative feedback and hopefully a ban from RFD.
