Hello guys,

I just need some advise as to what I should do. I purchased set of headphones from someone from states from another forum and paid using paypal. I paid on Sept 20/08 and have not yet received anything but seller has been in communication with me and is trustworthy, however I just want to secure myself and wanted to find out if I should file a claim with paypal just in case if it doesn't come to me as it has been more than 3 weeks now. Seller did not use tracking either and used the cheapes method however he charged me extra for shipping and paid $4.00 usd for shipping.

Anyways, what would you guys do?

If you haven't received it yet, how do you know how much he paid for shipping?

Anyway, go ahead and file a claim, because I think the cut off is 30 days. If you receive the item, you can later withdraw the claim.

Filing a claim with Paypal is useless if the recipient has already cashed out on your money.

I filed a claim before and Paypal conducted an "investigation" that took a couple of days, and later found that I had been scammed but because the other guy already withdrew the money, they couldn't do anything.

You have 45 days from the date of payment to file a claim.

If there are no funds in the seller's paypal account, paypal will still be able to recover your money in some cases.

I would file a claim - you will certainly win it.

Well I hope i didnt get scammed as the seller seemed very nice and does have good feedback too. I will file a claim today and inform seller about it.

I think its very stupid if they are unable to recover money if the seller has cashed it out, I mean WTF is the point of this security they brag about they should still be able to recover the funds one way or the other.

The reason how i know he paid $4.00 for shipping is because he told me the amount he paid and I have the pms saved too as proof. I will call paypal today and find out and start the claim.

Well I can share a recent experience with you Hu$tlah. Recently bought an item on Ebay, paid promptly and recieved the thank you invoice from the seller. Ten days later and still no item we log into Ebay to find the seller is now unregistered. Shocking as they had great feedback, no negatives in the past year, etc. Immediately start a claim with Paypal. Saturday was the date the seller had to respond to Paypal and they didn't apparently. Got an email saying they ruled in our favour and did manage to recover the full amount from the seller. We were absolutely shocked as that seems to virtually never happen. Maybe it has to do with the new buyer's protection, who knows...

Log into your Paypal and start a claim if you feel the need...
