I think I know how they got the pricing error. If you go to the weekly ad that is on-line, and click on the 8 GB touch which is selling for $249.99, you are linked to the 32 GB touch and if you click buy online, your cart will show the 32 GB touch on sale for $249.99. Those tech guys messed up.

Actully, the one selling for $399 is a different touch. It is the 1st generation one.

The new touch sells for $439.99 regular. And the new touch is still listed for $249.99. I wonder why they did not change it yet.

I got the same email. If they were going to cancel the orders why did they send that email?

BTW, I ordered really early, before 3 am Pacific time and got that email 3 hours later. They had ample time to cancel the order but yet processed it.
I think we have a 50/50 chance of getting our orders. The touch was clearly described as on sale and had it $190 off the regular price of $239.99. It is not a simple case of a transposed number.

i've had two previous experiences with bestbuy online and price errors.

first was 3 quad core computers. it was price errored, and cancelled, with $25 digital dollars x3 for compensation.

They shipped the computers anyways!! lol

second was guitar hero band kit, that one actually was cancelled, but they gave me $5.00 digital dollars.

both made it to processing obvs.

i would say, they will probably cancel this one and give us a $5 coupon.

I'll definitely work with you on this one. The legal terms aren't really clear/understandable to me, but from what I understood from the law, the words used are subject to interpretation. So, considering this, we deserve to have that article for 250$!

At this point, they can't just avoid giving it to us... it's like you're trying to say we can't honor it because there was a price error and THEN, they show a message stating there was a price error and they *STILL* make the error... come on!

Futureshop.ca is also OOS and I think it's the same warehouse. They usually get their stock pretty much at the same time. I don't understand how it can sell so fast at $400.

Sure it's a great gadget but I think it worth about... $250! Apple makes a tremendous amount of money on that, I saw the production cost of classic Ipod and it was a joke.

It's not about how many they ordered, it's about how many are available for them from Apple. They don't receive them often and in small batches. I read on the French FS forum that for a particular store, they got only 2 orders of < 10 each time (and there are 3 versions, 8, 16, 32).

We just don't know if it's an articial shortage like Nintendo did with the Wii :)

Well, I'm starting to believe that if he's seeing sometimes "In Stock" and then OOS, it's possibly because they do start having some stock in their warehouse, but maybe it is then shipped to someone so their stock is coming back to 0. A theory here, but that would be nice knowing someone does have its order as "Shipped"! :) :)

I just notice that 8 GB (new gen) now show in stock on Bestbuy.ca, probably a good news. I don't remember seeing any of the 3 models in stock online.

$440 is overpriced. I say 150 $ / $400 = 40 %.

HD example was more than 50%. But I like this error more. The HD deal was pretty hot at the time. Many had their orders canceled, some got their orders and it didn't matter when you ordered or where you lived.

In fact, even if it's a great deal, I think that a 32 GB Ipod Touch should cost $250. So the deal is to pay the reel value instead of a too big premium to Apple :)

No! You got the best deal ever! :) The last as little to do with that. You have $25 digital dollar, if you use it, BB wont sue you...

If the clerck makes an error by giving you 5 $20 bill instead of 4 (assuming you realize it later), while giving you your change, can you spend the extra $20? of course you can.

Main difference is Gen 2 has volume control button on the side.
Gen 2 also is in-line mic/control compatible. (Apple will sell headphone with mic/control later this year). Minor different includes thinner, shape more curve, screen is more yellow ... I don't know what i forgot.
