I got my driveway paved by www.northlandpaving.com about 10 months ago. I have started noticing that I have about 50 areas where I can see rust spots all over the driveway. Here is a link: http://www.flickr.com/photos/10749615@N02/sets/72157606016104280/show/

I contacted the owner and he came by. His explanation is that this is natural and happens and he is not responsible. He told me that if it looks bad, put a sealer on it and it will hide it for some time.

I have had my driveway paved by other companies and never had this issue.

Did he explain how that happened? Did he leave metal in driveway? Did you see any metal?

I would guess that there were some stones mixed in with the asphalt that had a high metal content, and the stones that ended up at the surface are now rusting.

My dad has a big stone in his rock garden that was all pink and gliterry when he first found it and dug it up, but once it was placed on the surface it began to rust after a few months. A couple of years have passed, and it is now one big ball of stone and rust. It actually looks kinda cool, so my dad has left it in his garden...but I'm sure he'd be mad if his entire driveway looked like this.

I guess your only option OP, is to follow what the paver has suggested and seal the driveway.

I know that sucks...so good luck.

Given that you'll want to seal the driveway after 2 (or perhaps 3 years), I would just plan on doing the sealing next summer and that will, as suggested, hide the discolorations.

His explanation was that asphalt is an aggregate and there is always a small portion of metals in the material. This happens and no one is at fault as it is the nature of the material. It is like saying that wood has a grain and some pieces the grain is more pronounced, then others.

All I know is that I never had a driveway that had rust spots in it, and the bugger from Northland paving basically says too bad so sad and won't do anything for it.

If this was such a common occurrence, I'm sure there would be tons of issues about rust and driveways by now on RFD and the web.
