patio door latch and foot lock doesnt work

my patio door latch and foot lock cannot be used simultaneously. i was sure it was possible in the past, but this afternoon, i was only able to lock one or the other. i had to push the door all the way shut for the latch to hook, but the foot lock was past the knock-out. if i "loosened" the door for the foot lock to go down, the latch cannot hook. what is wrong? should i get the builder to fix it?

also, they never installed the other piece on the screen frame to hook the lock. it was still in the plastic bag attached to the patio screen door.
