Hi there, I've had no problems with ICBC so far until I recently regarding a claim and possible negligence of ICBC's part, I just want to hear you guy's opinion whether this is common and advice what I should do:
a year ago in june, I accidentally tapped the back of a car in front of me with my right front bumper at 5km/h. we both got out the car to check the accident and his car has almost none damage except maybe abit of paint on his back bumper, where my right corner got really messed up.
next day at claims center, i admitted fault but realize that other party might be claiming injury and the adjuster said this mihgt be a serious case. I thought that person most likely is trying to take advantage of this situation because he walked out of the car fine and was young and healthy looking. anyway, i wil not try to argue with this. However, i told my adjuster to keep me updated of what his claims will be, since after a month i got no response, and no response from my leaving messages. This leads me to believe that the other party might not claim anything and I really want to get my car fixed. So since i wanted to keep my 35% discount, i went to fix my car privately without using insurance.
After that, 3 months went by and ICBC sent me a letter saying it is my fault and there might be claims. So then i called my adjuster again but they didnt reply to me and never sent any letters afterwards regarding what claims the other party did. This made me to assume the other party did not claim anything since the car had so little damage.
Now today, i receive my renewal and it says i have 0% discount so immediately i know that the other party claimed something. I called ICBC up to ask and they said the other party claimed $0 for his car and $16000 for medical. I was blown out of my mind , not that this guy actually got his false claim through, but ICBC did nothing to tell me this.
is it ICBC's negligence that they do not tell me what the other party's claims are? I believe I did my part of due diligence to try to find out what happend by calling twice ,leaving messages, but i did not get any call backs.
what can i do in this case?
i plan to call ICBC up to ask the if i can dispute the $16000 claim b/c i really think the guy frauded his way out of this. OR if its not possible, then i accept the 0% discount on my insurance BUT get icbc to refund my repair cost that i did privately.
any similar cases..? (i'm sure there are.. i've heard some horrid stories)
