View Full Version : I got SETUP by an Audi dealer.......

My family put deposit down on a brand new 2007 Audi A6 S-line($10,000 off the MSRP)the salesman also show us the car (at the back) that we will be getting ;however we received a call few days later said the car was already sold to another customer in the AUTOSHOW. And they said there are nothing they can do about it; since no where has 2007 A6 in stock.
Then the sales manager end up told us take the 2007 Demo (dark gery) with and extra $1700 off.
So basically, Audi sold me a car that was already sold..........
what can i do now? can i file a complaint to Audi Canada ? what should i expect? :mad: :mad:

I don't think a complaint will do you any good in this case. It looks like they just made an error with their inventory. Albeit on purpose or not.
They're not forcing you to take the demo model, are they?

You should be able to get the full refund back, providing that they can't get you the car you wanted (brand new rather than a demo). I would not take the demo for only $1,700 off.

my parents old audi was dropped off the same day when we paid the deposit....so my parent had no car/choice but they take the Demo with 1200km on it...:mad: they not even willing to provide extented warranty on that car.

If they had a contract to sell the car before they offered it to you, then there's not much you can do... I would complain if I were you, but I dont know what you'll get out of it. You can even try asking for proof that the car was sold prior to your agreement, just to make sure that they didnt sell it to some guy the next day for more money.

Was the demo a loaner, or has your parents already bought the demo car?
I don't understand why your parents dropped off thier car in the first place.

Mistakes happen, you weren't setup!
It's a human run business and therefore mistakes will occur. Your parents should have taken the deposit back (which I'm sure they would have been glad to give you) and bought a different car. I'm sure the salesman pressured them to buy the demo, but that's what salespeople do, they pressure you into a sale. Your parents need to learn to say no.
It's obviously too late now since they went through with the sale, but next time, get the deposit back and go elsewhere.

If you have signed a new contract for the demo I think your only recourse is a complaint, as legally you are now committed to that car. If not, you can definitely walk away (assuming they can not find a perfect match for the first car).

I've never heard of a car dealer doing a bait and switch. Your usual bait and switch scams involve low priced items that people will buy without much thought, not a $30,000+ vehicle.
It sounds like an honest mistake by the Audi dealership.

The OP makes it sound like the Audi (Wolf) is praying on helpless sheep (OP's parent). Whether this is true or not I'm not sure. I'm not personally fond of the Audi dealers I've been to but I'm not jumping to any conclusion as well. Most reputable dealer would not dare to pull off this stunt

The trade in is considered part of the contract. Since they can't get you the car you wanted, the contract is void, and I think you have every right to get your old car back. If this is the case, you can definitely file a complaint.

The dealership should have no problem managing their own inventory. Also, did your salesman do the "all have to check with my manager" crap when you did the initial purchase? If yes, that would mean two people at the dealership were unaware that a vehicle was sold, which I don't believe. And wasn't the Autoshow a couple of weeks ago?
I have reservations about how car sales work. A few years ago I signed a contract to buy a vehicle and waited for two weeks while the salesman searched Canada for the car and then tried to pressure me into buying with different options. And he kept giving me the MSRP prices for the options when he knew I had CarCost on the vehicle. In my experience I felt he knew he could not get the car originally, but had me agree to buy it assuming I would be commited for something similar.

I was wrong, he made me sign a conditional offer that if they can't get me the car I wanted, the deal is off. On the next day they told me they couldn't get me the car, and tried to sell me another car with more options (higher packages). They take your deposit even though they don't have the car you want, by lying to you that they can get you one. The point here is to lock you in and try to persuade you to buy something more expensive = more profits for them. I ended up getting back the deposit and bought the car somewhere else.

Provide us the full detail of the contract.
If they were going to sell you that particular car. They should have put the VIN on the contract. If they fail to do so, breach of a contract, you could take your trade-in car and deposit back at the very least.
However, it's too late if your parents signed another paper and settle with the $1700 off demo.

In my case the guy peeved me off so much that I ended up buying one of the 'option' cars directly from another dealership. He was not impressed. First he said "we have a contract" and I agreed and told him if he fines the car within the contract 30 days I was committed and wished him luck. When I went in to get my deposit back he put his arm around me and pointed at the service board and explained that the rates at the other dealership were $10 dollars higher and said that I would be paying those prices because I was not welcome back. I found out both dealerships (Hamilton and Oakville Volvo) have the same owner, so I put in a complaint, but I have no idea if it did any good.
Funny thing is when my wife tried to book service in Hamilton lately and they told her that they had to speak to the owner before booking it. By the time I called back they did not have a problem, but I was ready to tear them a new one.

This whole thing sucks, but at least 1200km on a demo is not that bad. Some dealers try to sell cars as "new" with more kms than that, so while it seems kind of underhanded what they did to your parents, it doesn't sound like the demo was all that used anyway. Dunno if that's any consolation though.

If the 'rents accepted the demo and drove off the lot, it's too late. That forms the new contract. The thing to do would have been to not accept delivery of the demo.
If you really wanted to push it, you could have demanded to see the other contract (confidential information redacted, if they preferred) to verify that it predated your contract.
If you give them the benefit of the doubt, they made an honest mistake. If you don't, they probably found a higher bidder for the car and figured they could pull a fast one....

1200km isn't all that bad, and I'm guessing since it's an A6 S-Line, test drive mileage probably aren't beater mileage.
Just ask the dealer to throw in extra goodies, all-season matts, free service, rust proof, etc.

I would've just told them that wasn't the car you purchased and now you want the deposit and the trade-in back unless they can give you a new car or something you guys can agree on.
But looking at how you took the demo, it appears that you've already agreed ... I doubt complaining will do much since you and the dealer already worked out a deal.
