Can someone shed some light into this ...I heard that if you hit a person's car in a parking lot, the cost is split 50/50 regardless of who is at fault?

Is this true????? I hit someone in a parking lot, just a minor bump hit at very low speed(<5 km/hr), so no damage, but the person could have made up a stratch,etc....but just wondering if that rule really exists, 50/50 split.

i don't think its a 50 50 auto rule...i think it dpends on the situation....each is different...oviously if u hit a PARKED car, its gonna b 100% ur fault unless hes parked illegally

The reason the 50/50 rule applies in a parking lot is because it's a private property and both parties had control of the car. Like kleptodathief said, it's not always 50/50 and it varies in different situations.

So what exactly happened in your case?

For example, this summer I'm backing up to get out and my car is half way out, I looked at my rear mirror, another guy just jumped on his car, put reverse. I horn like mad, but he hear nothing and keep backing up. My car is stopped since I see his reverse light and he just hit on me.........:mad:

I don't think this will be 50/50 in this case. my car is stopped and he still backing up and hit me.

It depends on the situation. Someone backed and tried to get out his parking spot and hit my car. It's his 100% fault. This happened to me many years ago.

That actually will be 50/50, there is no proof you were at a standstill. If you go hit a car that has no one in it and is parked in a designated parking spot then its 100% your fault.

How long does it take for you to back out of the spot? 10 min???
No wonder he hit you.

True! There is no 50/50. If u hit someone it's ur fault 100%.

no, the whole process of accident is within 20 seconds. I stop backing up further more after 3-4 seconds after I see his reverse light is on. If I try to move faster than him, then both cars is gonna hit together, then it's 50/50 instead of non fault.
Some people just don't look around the when backing up

Yep no 50/50,
My Uncle got hit as he was stopped trying to turn. Car backs into the side of his truck.

The insurance company tried to say it was 50/50, I recall him saying to the insurance company "Yes I drove sideways in my truck and hit him" LOL The other guy got 100% at fault in the end.
