View Full Version : Post-accident/Police Report Question

Hey Everyone

I'm wondering what can be done if the police have filed a wrong report and refuse to change it. Here's what happened...

-My mom was driving at night just after it rained in a silver car and was waiting to turn left (so the road is glistening which makes a silver car a bit harder to see)
-Another car speeds through the red and ends up hitting my mom who was turning since it's red (and she had checked to make sure it was clear)
-The woman admits she ran the red to my mom; and was kind of out of it to the point she didn't even know what street she was on or what intersection it was (but of course never mentioned any of that to the police)
-My mom gets taken to the hospital because she was already recovering from another accident and was aching pretty bad
-Cops meet her at the hospital and take her statement, then come to the accident scene to get the rest of the information
-the police rule it a 50-50 fault
-Claims are all filed with insurance....but insurance later says they don't do 50-50 fault and my mom will get 100% fault because it's yellow and she has to make sure it's all clear before turning (makes sense)
-we go to the police station to get everything changed so it's ruled 100% fault for the other party since we don't want our premiums to go up for an accident that wasn't our fault; we also managed to find a witness that saw her run the red and hit us
-policeman says he won't change the report, and that he deemed the other person's story more credible, and that for all he knows we paid someone to give a fake witness report; also said we shouldn't have moved the cars (except that they were in the middle of a fairly busy intersection and the cops took 2.5 hours to get there...we moved them just enough for cars to get through but basically left them where they were)
-we decided to order a copy of the police report to see for ourselves what was written down
-we get it today and everything's wrong....car colours, car models, even the city, and they wrote that my mom hit the other person when clearly she hit us

Now I'm just wondering if anything can be done to get the reports changed...
I mean, if the policeman couldn't even get the car model or colour right, how can anything else on the report be trusted?

It's up to the court whether a witness is credible or not. And if this officer noted the wrong make, colour of the cars involved in the accident, I think his credibility is shot.

insurance is a scam and they need someone to blame
they usually rule the person making the left turn responsible, 100% fault
unless the person that hit you mom admit so, likely not, she is off scotch free

with regards to the witness, if he/she didnt stay at the scene, or at least leave their info. i dont think they can come back later and claim a witness, but i could be wrong on this one
