Anyone knows if vacation time counts as part of your 2 week notice??

i.e. If I request my 2 weeks vacation for July 17th, and then on July 16th (one day before my vacaction starts) I submit my notice of resignation, will this basically mean I won't be coming back to the office?

I know it'll look bad, and I'll be burning bridges with the company

Logically acceptable, but morally frowned upon.

The employment standards act works in your favour here, as an employee is not required to provide any notice.

When calculating your final pay, they will make your last day of work your last physical day at work, and payout your vacation pay. Sometimes you are shortchanged as 4/6/8% may not equal your wage.

I jsut resigned after being 6 months with a company. Friday will be my last day

on my paystub, I have accumulated vacation pay of $450. Does that mean I will get that amount in fuill? ($450 is about 4% of my salary)

yes you get all vac pay.

to the OP - you can be sued for not providing enough notice. although this only applies to higher up & critical positions.

Isn't "critical" a bit too open for interpretation?

I mean, technically, the cashier at McDonalds would be crucial to the store - who would serve the customer? It would SO cripple the store, etc.

Technically, you have fulfilled the 2 week notice requirement this way, if this is what you meant to ask.

you have to take a look at your contract that you signed when you joined. Some contracts stipulate how many weeks notice you need to give. If it doesn't state, you don't have to give any notice and quit right on the spot.

Hmmm I guess I didn't answer the original question. I think your two weeks vacation will count towards your notice. Just don't look for them to give you good references.

The employer is under no obligation to accept the 2 weeks of resignation, and can terminate you on the spot and pay the vacation pay, rather then pay you 2 full weeks of regular pay while on vacation.

If they terminate you, then they have to pay out the 2 weeks (pay in lieu of notice), PLUS pay out the vacation. However, if they state "you cannot take vacation during the last 2 weeks", and you do, you will be fired and get nothing but the accrued vacation (termination with cause for insubordination). Therefore, it is in the company's best interests to do the latter.

Still, I agree with the others - you work the last 2 weeks... trying to use your vacation is sneaky and you will burn bridges. The intention of notice on your part is to allow for an orderly transition - you get everything done to pass off what you're working on to another person.

One thing that should probably also be considered - it's not only your relationship with your (past) employer that you would be sacrificing. You'll likely be giving at least some of your co-workers the high hard one going this route. I've been the co-worker left behind in one case like this, and let me tell you I'll never work with that person again. Training your replacement and doing the best work you can for your last two weeks is a VERY important part of leaving a job.

Of course if you hate your co-workers and boss, this is a good way to let them know.
