View Full Version : How Do I Get My Money Back?

Okay. I recently bought a brand new car for 30K. Normally you're suppose to put down 2K for a deposit, but I only put down 1K. So, I owe them 29K, when I went to the dealership to pick up my car, I was gonna pay them the 29K, but they goofed and they told me that I only owed them 28K. (They must have thought that I put down a 2K deposit, which I guess is the norm).

So I paid, signed on the dotted line and walked away with only paying them a total of 29K. Score for me right? That's what I thought too. Then about a month later, they went to my CC (American Express) and took 1K.

Can they do that?

I don't think they can do that. Who should I contact to get my money back? The dealers head office? AE? Tell them that they just went and took 1K? ('cause i never signed anything for that other 1k).

Thanks guys.

Go to your CC and dispute the unauthorized charge.

You could try to dispute it through AMEX. Personally I would just let it go but to each their own...

Really depends on what documentation they have. What's the total price of the invoice? If you didn't authorize the charge on AMEX that is fine and you can dispute it but in the end they will break down your payments and the invoice total. If there is a balance owing and it isn't paid they can say payment in full not received and put a lien on your vehicle.

You agreed on the price, you owed them $1000. Don't be a scumbag.

You owe them the other grand.Do the mature way and let this go.Or do a charge back and you will be in for a hell of a fight.

The agreement was for $30K, and you gave them only $29K. You still owe them that $1000.

By the way, if you tell the CC company what really happened, they will not help you with a chargeback. If you don't tell them the truth about what really happened, then it's fraud.

Yeh, do a chargeback - just think of the oil changes/service and warranty work you'll need done when the put a note on your file about you trying to scam them.
Be smart - give them a call and ask them what the unauthorized charge was for or just let it go.

You're better off with the 1k on the CC than a cheque.

You probably earned some points or Air miles on the AMEX. Enjoy those miles or points.

Technically, even if you successfully fight off the 'unauthorized charge' you then have a 1k owing.

If the charge you interest on it, then it's 1k+interest.

Whereas if you let it go as another one suggested, you had 1month of free interest on the 1k until you pay it off by the due date and those points/miles.

Eitherway, you owe 1k regardless.

Alright, you guys provided valid points.

What about the fact that I signed a piece of paper stating that, I owe them nothing? Doesn't that mean anything?

The probleam is the total price you had to pay was $30 grand. So yes they made a mistake but the fact is you still owe them the money.

It's not an unauthorized charge. On paper, you authorized a payment of $30k. In reality, they goofed up and only took $29k. They are still owed $1k and they have it in writing to prove it.

They probably should have contacted you first; however, they are entitled to that money and have documentation proving that fact.

If you go to your credit card company and do a chargeback, you may end up hurting your credit file and/or with a lien against your car.

They may also flat out refuse warranty work on the car (at all dealerships, not just that one).

$1k can easily be written off by a dealership, but the headaches you'll cause yourself isn't worth it. Let them keep the money they are entitled to, you'll be better off.

Lets put it this way, you owed the money and you knew you owed the money. You will have to pay it sooner or later. Even with that piece of paper, the car dealer could get a collector to get the money from you if you did not use a CC. You agreed on a sale price of $30k and you paid $29k... you need to pay the other grand regardless. You can goto small claims court but any judge will throw you out the courtroom and make you look like an ass at the same time.

You can try a charge back but if you do, watch the car dealer get a collector after you and you will be the one who has to pay the collector fees + any interest.

Bottom line, do the moral thing and don't do anything. You know very well you owe the money. Asking help for immoral things is not a good idea and don't expect anyone to be on your side.

It's more of an ethical thing. However, I think as a courtesy the dealership should've called the OP first before popping the charge through the back door. If he disputes it he would win because they (dealership) don't have any proof he that authorized the additional 1K.

Depends on how much crap you want to go through. You wouldn't be able to go back to that dealership for service though.

What I would do is a chargeback as it was unauthorized.

But then I would also call and ask for an invoice and pay them.

So that way they know they wrongly took your money, but that you are willing to pay them.

+1

I like this idea. That should teach them to authorize all payments in the future.

What if they new invoice comes with additional fees such as admin and processing? Then what?

I say just leave it!! You agreed to pay $30K for the car, and the fact is, you did pay exactly that much money to them. No more, no less. So, why even bother about it now?
