View Full Version : SLEEPERS Matresses and Beds in Brampton. Need your opinions on my situation.

Here's my dilemma with this matress/bed place:

Last Sunday, I go in looking to buy a matress. I speak to the sales person, and he's very curteous and energetic about the exclusive independent brand that they carry, SOVA. I take a liking to one of the matresses and ask questions regarding my situation if I ever have to cancel/return the order if I don't get approved for an apartment I'm waiting for. The sales person tells me that they can either hold the matress until I do find an apartment, or that if I need to refund the matress there would be no problem and no restocking fees.

I was hoping to hear about the apartment on Monday and would have wanted the matress as soon as Tuesday if all went well. The sales person, being curteous at the time, said that he'd have the matress dropped to the store from their warehouse on Tuesday just in case we do get the apartment so I can have it delivered to me that night.

I did not hear back from the apartment until Tuesday morning, and due to unfortunate circumstances I no longer need the matress that I bought at SLEEPERS.

I called in yesterday (Wednesday) to ask for a refund over the phone. I spoke to the owner, since the sales person I dealt with was not in. The owner said to come in today (Thursday) to speak with the sales person regarding the refund.

Today I walk in to see the sales person, and I get a very resentful welcome and am told that the store had paid money to order the matress. I get a lot of fuss and am now told that the owner wants to charge me a 20% restocking fee (yet the owner is no where to be found to tell me this himself). I find this odd, since the owner on the phone yesterday didn't mention any type of restocking fee when I told him I wanted to refund the matress.

After all the fussing and going back and forth, I find out that the sales person isn't authorized to do any refunds and that I have to come back on Saturday when the owner will be there to take care of it.

Now, I'm assuming that this guy is upset that he's going to lose out on his commission from the sale. The only reason he got the sale was because I was told under verbal agreement that if I had any problems prior to setting a delivery date, I could refund the matress without any charges (restocking or other). No delivery date was ever set or confirmed. No agreement (I checked the receipts) was signed stating that there was a restocking fee if anything were to happen.

Has anyone had any dealings with these people before? Can anyone comment on a similar situation, or know anything about merchant/customer agreements that can help me with this situation if the owner tries to stiff me? Can I be eligible for a chargeback on my credit card in this type of situation?

Any help would be much appreciated. Thanks!

Since this place seems small and independant, and the receipts are invoices you would buy at Staples, everything is under verbal contract between the customer and the sales person.

I was told lies to get the sale, and I believe I recall reading from my MasterCard bill that this is one of the reasons available to request a charge back.

I'm still going in later on this afternoon to speak to the owner. I was just hoping to see if anyone can comment on this situation... if they want to read such a long post at this time of the morning.
