View Full Version : Would mailing homemade copies of copyrighted dvds across the country be illegal?

hi, would it be illegal to mail a bunch of burned movies from toronto to vancouver, or is it best to avoid that, my friend says it is illegal but i dont think it is because i am not selling them i just want to give them to my bro to watch once and then throw out. is this "illegal"?

It's illegal to copy them in the first place. But I doubt that anyone is going to come and convict you over mailing your pirated copy of Shaving Ryan's private, and Grease.

even if they are copies of legal dvds that i purchased? is that not the same as me mailing my official copies, and having him mail them back, but saving some money and time?

Theoretically it's not if it is a backup copy for your own personal use, but mailing it across the country crosses that line.

mail it with a box of cookies or chocolates and dont lable the movies and you should be fine.

how much is a 'bunch'?

like up to 10 separte discs, but not in cases or anything that takes up to much shipping space ill just put them in like one case that holds them all, or a cd wallet. obvioulsy i know ways to hide it, but like theoretically if they did find them i just want to know what the law is. isnt downloading of anything completely legal in canada?

The way you phrased it was incorrect.

Downloading movies is illegal. Copying movies not intended for your personal back up is illegal. Giving your back ups to someone else is illegal.

If you were to do just that then there's a 99.99% chance absolutely nothing would happen.

Although if you did that and then went to the police and described in detail what you did, you may possibly be charged with something.

well if you dont put a return address, your bro cant get in trouble. Cause then if you wanted to get someone in trouble, just mail them a burned movie :p

If you mean like running a mail order company then yes it is very illegal.If you send out less then 10 then no it is not.

OP, making copies is not legal in the first place, unless they are for backups for movies that you purchased ORIGINAL versions for. Even in that case, the copies are for backup purposes only, once you give them to someone else, it's not a backup copy anymore.

This is totally illegial. Just hope the best for you. Of course, if you know what you're doing, nothing should come up. I suggest you don't put a return address.

Ok, your mail is not screened like that unless it goes across the border... sure if you are in a bigtime crime syndicate and the police see a heavy flow of cd-like packages coming from your address....they'll take notice.

But a disc here, a disc there.. no one cares.

Having a return address on something like that is just ********.

ok ... here is your legal answer. The Copyright Act 1985 C-42 section 80 you are allowed to make copies of works, performances etc. for private use. Bill C-60 amends the infringements to copyrights by adding the following after subsection 2.

(2.1) It is an infringement of copyright in a work, a performers performance or a sound recording for a person knowingly to do any of the following acts with respect to a reproduction of the work, performance or sound recording that the person knows or ought to know was made as a copy for private use under subsection 80(1):

(a) to sell it or rent it out or, by way of trade, expose or offer it for sale or rental;

(b) to distribute it, whether or not for the purpose of trade;

(c) to communicate it by telecommunication to the public or to one or more persons in particular; or

(d) to perform it, or cause it to be performed, in public.

Likelihood of getting caught though is slim I would assume, but there's the law for you :)

so technically... if i go to say, FS and buy the newest DVD released, and let my friend borrow it, it's illegal? OR watch it at my residence with a friend, since it's being viewed by more than one person?

I wouldn't expect any problems if you did this. Technically it is illegal, but as long as you are not creating permanant duplicates, and selling them for profit, I can't see the rcmp knocking down your door anytime soon.
