View Full Version : Parking ticket, obstruct sidewalk, possible fight?

I went to my buddies house tonight and parked on his driveway but part of my car was over the sidewalk. I got a ticket from the town of markham for 35dollars. Man what a BS law, who uses the sidewalk in the middle of the friggin night. If I decide to fight it you think they will set a court date so far away that the person who wrote the ticket will forget? Or should I just pay the 35 and then moan and ***** some more about the stupid law.

EDIT : BTW time of the ticket is 1:16AM. Man nobody uses the sidwalk at that time and there is NO snow to be shoveled the next morning and I left at like 2AM. What a stupid law.

hmm.. if its aparking ticket it was most likely issued by a municipal law enforcement... so yuoll have a hard time fighting that one...

Pay the ticket. You parked obstructing a sidewalk. Doesn't matter what time of day or night it is.

I was just wondering where the hell i'm supposed to park then, seeing as if I park in the street I get at ticket, and on my friends driveway it obstructs a sidewalk. man thats total BS. I understand if its daytime and people are using it or if i'm parked there when snow needs to be cleared but 1AM tonight?! Out in the middle of a suburb?


Anyway if I do set a court date where will it be for town of markham? Maybe its not worth it but I hear if you set a date far enough to challenge evidence or whatever they might not show. How can they even prove my car was there do they take a picture or something.

Its the same thing as no overnight parking on the streets. Just pay the $35. If you elect for a trial, it will be held at small claims. They can prove your car was there because you have a ticket.

Markham its small claims? Where is the court house for it for markham? Just cuz my car is there doesn't mean the infraction is true. Maybe I should go plead guilty and maybe they'll reduce it? I dunno.

I have no clue where the Mark. court house is. But I do know where the Richmond Hill one is :lol:

If you peed guilty with an explanation, it maybe reduced. However theres not really anything they can reduct it by since its so small. Talk to the JP and see what they can do.

Its not a stupid law you did something dumb and thought you could get away with it.

you assume he knew the law before he parked there. thats just wrong.


oni-kun - go find out what the laws are regarding parking a car in markham.

I know in north york, on my cresent you are not allowed to park cars after 2am on the street from november to april or something like that.

Knowing the laws like this one can help you in the future.

Oni-kun, was your rear tires on the driveway? If they were then I think you can fight it. But I do not know the law and what blocking the sidewalk actually is. Thats one suggestion.

Heres another option:

Assume the law is you cannot park your car on on the sidewalk after a certain time. Say 11pm.

Take it to court, say you went to your friends house at an earlier time, you took some pain medication for your wisdom teeth that got pulled out. And because the medication is so strong it was advised that you do not use heavy machinery after you take it. You could also say it knocked you out around 10pm and you ended up sleeping over.

This happened to my brother before. The ticket was thrown out.

First all 4 tires need to be on the driveway not just two.THe winter parking law states in ont you can not park on any street after 2:am.LIke it or not the sidewalk is part of the road.

What happens if I am lost at 1 am in Markham on a dark street trying to find my way to a friend's house and I walk into this parked car on the sidewalk? >:(

I was visiting a friend in Mississauga and I parked on their boulevard (portion of driveway between sidewalk and road curb). I got a ticket. I violated two bylaws. Parking on the boulevard which is theoretically city property and my bumper (just my front bumper) was hanging over the sidewalk.

Friend had actually warned me cause they've gotten tickets in the past for the same thing. I was too lazy to move the car. Had to suck it up.

Markham permits parking on most side streets till 2:30AM unless posted. You can go to the ticket office at the town of markham at warden and hwy 7 and they will cut the ticket in half on the spot, If you still want to fight it, I beleve you either go to the York Region building at High Tech Rd/Hwy7 or the courthouse in Newmarket. I dont remember specifically which one

I use sidewalks pretty much all the time... Isn't that like saying "I parked across an intersection but it was 3am! who drives at 3am?!?!"

Your buddy's paved driveway is private property, so no tickets. But that strip of pavement cutting thru your buddy's driveway is city property, so they can issue tickets.

Yeah its a silly law, but I'd say your chances of winning it is pretty much zip. Unless u took a picture of it and your bumper was just a tad over the line or something. Other than that, its an issue of getting to terms with what happened. Don't fight the system, get even in other ways.

That is why one of the big factor in choosing my house is "no sidewalk on my driveway".

And, yes, there are people walking at 3am if they choose to. And, some jerk could just park their car on the sidewalk and block the whole sidewalk bumper to bumper and nobody can pass through without going all the way to the middle of the road. That may not be easy if a stroller is involved and there are snow banks.

Why would one walk in the middle of the night with a stroller? Having a party in a neighbour's house.

BTW, if you are going to left by 2am, why didn't you park on the street? Just don't forget to move your car every 3 hours.

Be smart, Park Parallel to the sidewalk so your bumper is over the grass, not the sidewalk!

Personally, I despise people who obstruct the sidewalk with their vehicles. I don't appreciate having to walk around the car into the street and back on the sidewalk, especially in winter when there is ice and snow. If you do not fit, park somewhere else, pure and simple.

Take it a step further, what if it was a senior citizen, or someone using a walker, wheelchair, etc? The sidewalks are there to facilitate pedestrians. They are not there as an extension to your friends driveway.

It is a $35 ticket, is it really worth all the fighting, scheming, etc.

I know my time and integrity is worth alot more than a measily $35.

lol that's Ottawa... a crazy nutty place with the *shudder* senators as a hockey team :D jks

This is a standard bylaw everywhere. Sidewalks are for pedestrians, not vehicles, even parked ones. ;) No part of a vehicle can be parked on or overhanging a sidewalk. Not even an inch of a bumper. You know what they say about assume right? ;) This bylaw applies 24 hours a day, 365 days a year, no exceptions...

I agree with direct-x, it's one of my pet peeves along with people that don't shovel their sidewalks... :mad:

1)From nov-apr you can not park on the road after 1:00 am.

2)You are not permitted to park on your lawn.

3)You can not have more then 3 cars on a single car driveway.

4)YOu can not fix your car/truck on your driveway.

those are easy to fight...not even fight..just go and say u are poor and wont do it again. they'll waive it or reduce it to some stupidly low amount.

A single car drive way is just as it sounds its single not double not triple.IN the city your not going to have a 100m driveway.

There are. I have just driven by a few yestarday in Youge and York Mills. Okay, not 100m but like 70m. My daughter joked that she could do her exercise by just walking up and down the driveway.

I'm one of the ones that HATE it when the sidewalk is blocked. Forces me to walk on the street. Back when I used to live on Davisville, some of those Greenwin apartment buildings would run their sprinklers continuously over the sidewalk late at night. If I missed the bus and had to walk home, the choice was to walk on the street, or to cross the road and walk past the really dark park (or, I guess to get drenched in the sprinkler!) I chose the street.

Lots of motorized wheelchairs, baby strollers, walkers. Doesn't matter what time it is, or where you are. If it's a sidewalk, it's for people, not cars :D

What's worse is the idiots that PARK RIGHT ON THE EDGE of the sidewalk but their trailor hitch and ball is sitting 8-12"onto the sidewalk just WAITING to nail a shin or an young child.

Last weekend I got a parking ticket in Vaughan because I had my "left tires to curbside". I already set up a "first attendance" meeting, but I was curios if anybody has any idea if I have any chances.

The street is a 'no-through' traffic street and it happened at 6pm on a Sunday.

I could understand if you were in the right- fighting to prove a point- but you were wrong. You parked illegally and were rightly ticketed for it. Now you want to waste court time because you don't want to pay 35 dollars.

I fight it because it is a Vaughan by-law. How am I supossed to know the by-laws of a city and repect them?

I am not a Vaughan resident, so I am going to try to fight it anyway.

I think it's the law pretty much anywhere that you can't park on facing the wrong side of the road.

My dad also got this ticket, we just paid since it's not worth the time to fight $30 in court.

his excuse:

i went to my friends house. he told me his wife is pregnant, we had some champagne to celebrate. I was under the influence. I was going to move my car, but it was safer just to leave it there.

it will get thrown out.

my brother got a parking ticket for parking on the road after 2am. he had recently cut himself badly 22 stitches. he had pain medication. makes u drowsy, he said he took it once he was there and was done for the night. it got thrown out.

stitches were on his ass. would have been funny if the judge said show me the stitches and he moons the judge lol.
