Hello fellow RFD'ers,

This past long weekend I was driving to NY from Toronto and got pulled over for speeding. The ticket asks for me to mail in and state if I plead Guilty or Not guilty.

I guess my question is, since this happened in the states, will they take points off in addition to a fine and will my car insurance increase?

Thanks in advance.

Here is what is posted on the MTO site. So yes a ticket you get in New York State is no different than if you got it in Ontario.

Here is the link to the MTO website pertaining to this:
http://www.mto.gov.on.ca/english/dandv/driver/demerit.htm

Demerit Points for Out-of-Province Convictions
Drivers convicted of a driving related offence in the State of New York, the State of Michigan or any Canadian province or territory, will have home jurisdictional penalties such as demerit points and/or suspensions applied to their Ontario driver record as if the offence occurred in Ontario.

Examples of out-of-province convictions where Ontario demerit points and /or suspensions will be applied include:
Traffic Criminal
Speeding
Fail to obey stop sign
Fail to obey signal light
Fail to stop for school bus
Racing
Fail to remain or return to the scene of a collision
Careless driving
Motor manslaughter
Criminal negligence
Dangerous driving
Failure to remain at scene of a collision
Impaired Driving
Driving while disqualified or prohibited

My brother inlaw was telling me one of his coworkers got a speeding ticket in the states. She pled guildt, paid the fine in the mail. A few weeks later she received a notice from the state asking her to pay a state tax on top of her fine, which was approx $400USD. Unfortunately she had no choice since she pled guilty on the ticket. You may want to do some more research on this!!!

I got a ticket in NY, I think it's yet to hit my insurance here. That was 2 years ago. I was literally.. 10 minutes from the border.

NY State Troopers LOVE to peg people 10-20 minutes before they cross the border... I've seen tickets range from 70mph in a 65mph zone all the way to 90mph in a 65mph zone.

At the crossing I used to work at every now and then the State Troopers would hang out at the north bound duty free with the radar going. You'd see a car coming (faster than the posted limit), the State Trooper would hit their lights but if the car kept going till they were over the line the Trooper would shut off the lights and turn back...

What you are describing is the NY state equivalent of our victim impact surcharge. Ours is built right into the fine while theirs is billed seperately...

That seems very odd. I'd think you'd be able to get that money back, just like you can get the tax back you have to paying winnings from their casion's.

hahahaha I got booked going 85 in a 65 this weekend as well. damn hick town trooper. anyway i plead innocent but i dont intent to go to syracuse for the trial. I dunno tho, the ticket says i had to mail it within 48hrs (in one part of the ticket while another part says i have to mail it b4 13 days ) but i couldnt mail it since it was on a friday. and then we had labour day as well on monday. Sigh, i only hope my insurance doesnt go up. i dont care about the points or fine, just the insurance!

It's not a tax, it's the victim impact surcharge. It has to be paid if you don't want a warrant issued for your arrest. IIRC, because of the recipricol agreement renewal of your plates and license can be denied as well. The only difference is that due to their accounting practices it's billed seperately where as ours is built into the face value of the fine...

I have heard its a roll of the dice if it shows up on insurance here,, as not always does it get reported back even with agreements set between NY and Ontario

Thanks for the replies everyone,

Blazin_Sunfire: I was going 82 on a 65 and on the ticket, from my interpretation you ahve 48 hours to request for a disposition and theres a date to reply by mail stating if you plead guilty or not guilty.

So I guess a NY speeding ticket would be considered as if the offence was local to Ontario. Im not worried about the fine, but its the insurance that im worried because im only a G2 driver as well. :(

Translating that charge into metric, you were doing about 132km/hr in a 105km/hr zone. 16 to 29 km/hr over the speed limit is 3 demerit points. Insurance companies will see that as only a minor infraction, and will overlook it as long as this is your first ticket. If you have any other marks on your driving record, then you can expect some increase in your insurance.

I received similar charge when I had my G2, and my insurance didn't go up since it was my first and only ticket that I had on my record (knock on wood).

ohhh. i interpreted it as 48 hours for a plea of innocent. however, if you plead guilty you can mail it past the 48 hours. Your explanation would be better for me then lol.
