I have a couple of questions.

1) is that only people in payroll is entitled to have paid vacation(or 4%vacation pay)? contractor doesn't count?

2) How to define a person in payroll? If I have to pay EI, CPP, etc. Is that mean I am in the payroll?

3) When does the vacation cycle start? On the first date get on payroll or 3 months after probation?

Would be nice if I have the link for reference. (to back me up when I go back to HR)

Base on what I read above, I should have vacation since the first date I work for my company.
She said I am a "contractor", so I am not eligible.
I didn't bill my company and I paid all EI, CPP, etc.

What should I do?

Are you receiving pay stubs? If you are paying EI, CPP and taxes then you are on their payroll. If they say you're not, they shouldn't be collecting those on your behalf and they are ripping off both you and the government.

When you were hired did you sign a job offer letter? Just read what you signed (or what they gave you) and it would have to specifically state that you are a "contractor" for them to be able to withold your vacation time/money.
