Didnt know where to put this so I will put it here.

My brothers car was hit at work a few days ago. He works at a bank which is across a Zellers. When I say across, it is not really close, but you can walk there, it takes a couple of quick minutes.

Anyways the Zellers cart hit my brothers car, his alarm went off during work and he got his friend in the bank (he was busy with the customers) to go look at it for him.

So anyway he files a cliam to Zellers, completes a form and now waits for their phone call. Zellers insurance group calls today to say that they are reviewing the incident but they gave their usual BS, we have no control over what a customer does with their carts, this and that, and says that we can however apply and take them to a small claims court.

Anyways they CAN control what customers do with their carts. They can hire people to look after carts such as what Fortinos does, and they can build the cart posts to put in the middle of the huge parking lot. The only place where you can put back the cart is in the front of the store, and most people are lazy not to walk that far.
Also they can make their carts take at least $1. Very little people would want to lose a dollar.
Lastly they can do what a Price Chopper did, build a barrier right in front of the store to prevent ANY carts from going away from the store.

Anyways we are looking for people who have had similar experience and tips we can have to get Zellers to pay for the damage. Any successes, failures? :mad:

It seems pretty weak right now because they always try their best not to pay for anything.

The damage is like a dent, and you see the paint stripped off and see the metal. There is most likely going to be rust forming if something isnt done.

I don't think you should file this incident.. unless your brother is willing to pay the premiums in the upcoming years. Some things are best left alone.

Also, you can't hold Zellers liable for other people's mistakes. It's not like THEY did anything wrong. It's for the same reason that when I go into a parking lot, I park further away to avoid "accidental" damage. Generally, people are careless and don't give a damn about where to leave shopping carts..

And for the "at least a dollar" part, research probably indicated that people generally have quarters lying around (either in their pockets or in their cars). Not to mention, to replace all the current $0.25 operators would be very costly.. It doesn't really make sense IMO..

I suggest you take no action. I mean, it will be really hard to actually win this, so don't try. That's what I would do, I'm lazy.

how bad was the damage?

anyhow, sorry to say, but i don't think you're gonna win here, good luck tho

making the cart cost a dollar won't really prevent people from hitting your car, even if the cart costs me 50 bucks, i could still ram it at 50 different cars before returning it.

if you're going to suggest a solution to Zellers, maybe suggest to them they should only allow carts indoors, and install to posts that prevents carts from getting by, but then again, people will complain having to drive their car up to the store to unload the cart, which means zellers probably won't do it

It's for the same reason that when I go into a parking lot, I park further away to avoid "accidental" damage.

He was parked far away from Zellers, far away.

BTW our premiums wont go up because it has nothing to do with our insurance company. Its going through Zellers insurance. You guys got it the wrong way.
