Long story short... i bought a black ipod video 30 gig on ebay that was stated new but when i reicieved it in the mail it clearly was used and the screen was scratched. i contacted the seller and he said he inspected it before sending out and basically was just trying to get out of giving me a refund. i filed a dispute with paypal over a month ago and now this is what i got emailed to me:

In order to continue with the investigation of your claim, we must request
documentation to support your claim that the item is damaged or
significantly not as described. Please obtain a document (such as an
estimate or invoice) from an unbiased third-party, such as a dealer; repair
shop, appraiser, or another individual or organization that is qualified in
the area of the item in question (other than yourself), which details the
extent of the damage or clearly explains how the item received
significantly differs from the item advertised. Please do not proceed with
any repairs or alterations to the item, as doing so will limit PayPals
ability to successfully resolve your claim, and may result in the
cancellation of your dispute. If possible, the document should include a
serial number and description of the item, and the dollar amount required
to complete the repairs necessary to correct the damage. This document must
be on letterhead that includes the name, address, and phone number of the
individual, business, or organization so that PayPal may contact them if
necessary.

The documents should be faxed to PayPal at (402) 537-5760 (please note this
is a United States phone number, if you are faxing from outside the United
States, you will generally need to dial 00 1 before the number). Please
include a cover sheet with your fax that includes the email address
registered on your PayPal account and the ID number of your claim
(PP-138-208-373) so we may attach the document to your claim as quickly as
possible.

We must receive your fax within ten days from the date of this message in
order to proceed with the investigation of your claim. If we do not receive
your fax within ten days, your claim will be cancelled. Unfortunately, we
are unable to grant extensions to this time period. Please note that PayPal
is unable to reimburse you for any costs or fees that may be incurred in
obtaining the requested documents. Any documents you provide may also be
supplied to the seller in your dispute.

I have no idea where i would go to get an ipod appraised. I am guessing that I am out of luck and should just swallow the lose. Anyone wanna help me? :-0

Just do a chargeback on your credit card. That'll teach him.

how so if the item was received? chargebacks aren't used when you get something you don't like.

well i would call them and ask and see if they can give you any ideas, maybe type up a description ect and get a notry to sign it ? as that would be a 3rd party bias opinion

They will do it if you receive something very different than described in the auction. However, I'd just keep the damn thing if it works.

Bring it to an electronics repair shop and see if you can get something down on paper regarding the ipod being used.

Not much else you can do besides that.

I refuse to buy any electronics through Ebay for reasons like this - scams left and right.

Tough one to swallow.

Personally I wouldn't be able to just "let is slide" but I also woudn't have bought an IPOD or any electronics for that matter on an auction site notorious for scammers.

first course of resolution is with the seller/buyer.
and because an item is "scratched" does not warrant a chargeback.

visa is not a 3rd party that guarantees all transactions.

thanks for the help. i think i am just going to end up taking it as a lose because i am not gonna go through all that hassle to save a few bucks. i wouldnt have minded keeping the ipod if i didnt pay the same price as it costs new. i only bought it only ebay because i had money left in my paypal account and did not want it to go into my bank account
