View Full Version : Banned from school, what should I do??!

So, I'm banned from Earl Haig SS. I can still go to school, but I can't stay there after the school ends. If they find me there 5 mins after the bell rings, I'll be arrested! :-0.
Anyways, this is what happened. A week or 2 ago, I went skateboarding with my friend. I suggested the Xerox building, but he said that we would get in trouble so instead we should just skate at our school... bad idea.
We were skating for a while when a TDSB security guard pulled up in his car which said "...Protecting our schools". Oh NO! Protecting them from what? Skateboarders? Well since we skateboard, we MUST be into drugs and violence right?
Anyways, he asked for our information (I'm an honest guy so I gave my real info, even though he was only a security guard) and reported to "base" or whatever. All I heard was "Yeah, Alpha delta aero, blah blah blah" Wth?? Secret TDSB language?? Well, they found out that my friend had been spoken to before so they put him under arrest (can security guards do that?) and called the police. We were really calm about it though. We just sat there for 2 hours waiting for the police while making jokes and watching my friend try to drink from a bottle with handcuffs on. He also wanted me to scratch his nose but being the good friend I am, I didn't.
FINALLY after day became night the police showed up. The security acted like dogs trying to get the police's attention and sucking up to them (laughing at the lamest jokes, acting twice as much of an assh*** to us to make themselves seem tough). The police were also rude. One of them kept yelling at my friend for stupid things like nodding instead of replying with a "yes" and whatnot.
The police took my info and the security guards gave us banning slips right after. The stupid part was that I was allowed to leave long ago, but I waited for my friend. If I didn't then I wouldn't have had to give my info to the police and PROBABLY wouldn't have gotten banned. Damn my stupid friend! Damn him!
Anyways back to my question. Does anyone know how I can solve this problem and get unbanned? Btw, the security guard said that our offence was trespassing and skateboarding and that the ban is FOREVER.

you are first a student! and got legal right to be there..

Well, my friend's granpa called and they said that they have a LOT of people banned, so they check regularly. Although I AM asian, so I just have to jump into a bunch of chinese people and they'll never find me! :lol:. I even have a fake name and address ready.
I know that it probably won't be inforced, but I don't want to take the chance. Getting arrested, being charged $70, and going to court doesn't seem very nice to me. I just want to go to school without any worries like that.
EDIT: To them, I am a student and legally am allowed to stay, but after school is out, I'm considered tresspassing.

sounds like small stuff man.
i thought u were actually banned from skool but u were banned from playing there after skool. no biggie. take ur skateboarding fun somewhere else.

Wow that's crazy. At my school you could get caught smoking pot and it would only be a one week suspension. In my city, you're not allowed to skateboard downtown, but at school you only get in crap for rail sliding and crap like that.

just for future reference
unless the law has changed recently, a security guard cannot LEGALLY hold you for more than 15 minutes until the police shows up. This is at least the case in malls. If within 15 minutes the police is not there you tell them to **** off and leave.

This sounds like a really stupid punishment...
why would someone BAN a student from staying after school? It seems to do more harm than good. Instead of having students STAY after school to help clean up, do extra projects, volunteer, extra activities etc. The system wants students to get out of school as soon as possible to go cause trouble elsewhere.

If you can still go to school, you aren't banned. Go home & study or skate somewhere else, not a big deal.
What if he has to stay late for:
sports game, extra-curricular club, handing in an assignment, working with a group etc?

I think it's good you got caught and punished for skating on school grounds. There are many places that are ruined because skaters grind the edges of cement and such and the cement turns black and unattractive b/c of the wax.

Ok, here's how it works.
a) A security guard CANNOT legally detain someone. Now, in the case of suspected shoplifting, it's common for the store owner/security to "persuade" the individual to stick around until the police arrive. Again, not legal, but often tolerated.
b) A security guard (or the owner of the private property you're on), however, can arrest someone they find committing a criminal offence on that property. In the poster's case, the arrest of his friend was legal (based on available information) because he was violating the trespass to property act.
Now, once a security guard performs the arrest, they have to "deliver" the arrestee to a peace officer. Calling the police is the form most commonly used. Until the police arrive (even if it takes a few hours), the arrestee is in the custody of the arrester. It should be noted that the arrester cannot decide to let the person go, after the arrest has taken place they MUST be turned over to the police (or another peace officer).

go skate somewhere else. If you haven't been expelled from the school by the principal then there should be nothing to worry about. Just dont be skating on school property again

sports game? too bad, that's part of his punishment; play/skate somewhere else.
extra-curricular club? too bad, that's part of his punishment; join a non-Earl Haig club.
handing in an assignment? too bad, that's part of his punishment; hand it in during class like you're supposed to.
working with a group etc? too bad, that's part of his punishment; meet up with the group during school hours or somewhere else like the library or a persons house.
His friend was already caught doing the same thing or something else, so you should really blame him. He should've known better.
If it's that serious, take it up with the TDSB, and you'll get a reply in a few months after the hearings.

Hey... it's not like I'm gonna still skate there anymorw. I'll take it elsewhere but all this means that I can't just hang out with my friends and that I'll probably have to end up going home right after school.
I was just wondering if anyone was in the same situation as me, and if they got out of it or if they know if it's inforced or not.
And no... I don't know Victor P... should I? :confused:

Yes thats what I immediately do when I get home from Haig. Midevilshadow, why don't you board at the Princess Park? Lots of boarders are there, i can see them from my window ;)

Yea, security guards cant hold u..they *could* do a civilian arrest, but almost always those end up badly, they arnt trained for it, f up, could get sued..
And he was using the phonetic alphabet, like the military use alpha, bravo, charlie, delta, foxtrot, echo, gamma etc.. might be wrong on a few, been awhile since I used it :| ..I would prolly talk to school about it (I dont skateboard) but it could look bad if some1 found that info...besides, u didnt get a warning, u were tresspassing, but I believe u need a warning (well I geuss school prolly has sign) but its not like u know ur friend was warned.. be civil about it, theyll prolly look into it..

hm.. i had a few friends who climbed onto the roof of our old elementary school once (back in hs)... some old guy with nothing better to do called the cops and a cruiser came chasing my friends across the school yard. after a while my friends just decided "wtf. all we did is climb a roof wut r they gonna do" so they just gave in... the police told them it's a good thing they gave in because they had several 'hidden officers' walking around to catch them...
but in the end the police let them go... w/o any charges... hah i guess ur just unlucky.

lol ok. Lot's to do across the street... also there's a house there, so that'd be trespassing unless I stay on the side walk.

Errrrr... what good is studying if it'll end up in me being alone all the time?
Damn it. No one has a solution??? I mean the guard's book seemed full. There must be someone where who's gone through this or something like this.
Then again... I may try calling TDSB like someone sujested, but I HIGHLY doubt they give a damn about me. >:(
EDIT: Now that I think about it... I could have ran/walked away............ then again he had a gun. I don't know if it was real though.

Are you sure he had a gun? Security guard in Ontario vary rarely carry them; it's unlikely he would have been authorized to carry one. And yes, carrying a fake gun in a holster is illegal.

i went to Haig for 4 yrs and I swear everyday after school there's ppl skateboarding at that courtyard till dawn. So it didn't seem to be a problem back then.
But when I visited my school this June I noticed they added handrails everywhere.
