Price error on the web. Flyer shows $50 instant saving, $70 MIR. FS has once again mistakenly added the two together and then still offer the rebate.
I suggest printing out the web page and then going to the store with it. Online orders will probably get cancelled.

That's weird... cuz rebates always ask for a COPY of the receipt. You never EVER need to send the original.
I've never had any problems.

After receiving your item, go online into your order history - you'll see a printable invoice. Print this and submit it with your MIR.
Or as soon as they ship your item, you should be able to log on and see the invoice.

I thought that FS usually honoured online pricing errors IF AND ONLY IF you ordered one of the item in question. If you ordered 2 or more, they would cancel your order.

As long as they haven't detected the error, they'll keep processing orders...so if you ordered more than one, it might still go through.
This MIR is manufacturer direct and they are in California, so it will be out of Futureshops hands as to how long it takes for the MIR to come back to you.

Update:
I took a walk to Yonge and Dundas and picked up one of these drives for 129.99 + tax - GC ~10:00.
The first person I spoke with was amazed @ the deal once he scanned in the price for a check. However, the checkout rep was going by the flyer... and was equally amazed once I brought the new price to his attention :P
Apparently, RFD has already maxed out my CC... :cheesygri , so I paid on debit amid a rather long process complete with system locks...
During the wait, the first guy I spoke with semi-complained with a smile on his face about how he was fielding calls for the drive immediately following my arrival.

PS, even better deal. My unit has 2 firewire ports. WEeeeeeeeeeeeeee. Gonna try and get another one at lunch for a bud.
PSS they don't include the $50 firewire cable :( Glad I have one at home :)
Did the box only say USB 2.0?
My box didn't display anything about firewire... and I cannot open it until after work

Yes, this product has 2 Firewire ports.
Inside your package you'll see a note from Acomdata, stating that their USB-only model was delayed in production, so they shipped out their USB + Firewire model instead.

Hi guys, compare to TD's $59.99 160G +
$17 HD enclosure
Which one is better?
Thanks!
Not sure about that one, but this one is a 2MB buffer but has firewire enclosure
Yeah, just check it. This is external Western Digital 160GB has USB2 + firewire... similar to the one compusmart is selling at $99 (after $70 MIR)...

I'm sure Acomdata will not have a problem with the rebate. As I recall it's a manufacturer's rebate, so they will know that they only have one product released :)

From the one my boss bought at Compusmart, they placed the firewire model in the USB version's box, so the UPCs will match.
Yup. The box says nothing about Firewire. I got the note inside saying that the USB only ASICs were delayed. No firewire cable, but that's okay. I have a few anyway.
The casing of the drive is one of the best I've seen. A nice heavy metal feeling to it. Better than the cheap plastic crap most other companies offer.
The UPC is 708769030107 and the SKU is 50500C.
I, uhhh... had to check and make sure everything inside was all right, and it's also a WD1600BB model drive. Specs here: WD1600BB specs (http://wdc.custhelp.com/cgi-bin/wdc.cfg/php/enduser/std_adp.php?p_faqid=1232&p_created=1091035775)

I guess 8MB is probably overkill for external application. In fact, I think even 7200rpm is not neccessary. The real-life throughput of USB 2 external is probably ~ 20-30MB/s.

Yup... easy to remove. Pull the back plate off - it's just stuck down with tape on its underside. Remove the 4 screws and pull the plastic plate. Slide the whole metal chassis over the drive unit and you're ready to remove the drive. It's a standard IDE 3.5" HDD.

Picked one up at Downtown Toronto. I went at 12:00, and the guy there was telling me the price was changed back to $199.99 - $70 rebate. This sales person would not budge. :(
I walked around a bit, and I THINK he went for lunch or something. Then I saw another person (a RFDer may be?) picking this up at $129.99 - rebate. I have dealt with this salesperson many times now, and each time he is courteous and helpful. I cannot disclose his name though, as he might get into trouble by giving us RFDers the best deals...

Got mine at the local FS. No haggles and no problem. Nice little case.
Their is a sticker on the box refering to warranty validation if you open the case. Does anyone know what the drive is inside? EIDE, SATA, etc.
Thanks,

yeah I paid 129.99, would be gettin a 349.99 CG in return....hmmm really tempting
So if I keep the other 160 GB, It's practically free...just that I would stuck with a gift card. Give it to my parents, they need to get a new fridge anyways from FS
IF you can get the full price back or the 250gb, then go for it! if not, i would just KEEP it for $129.99. screw the rebate, that's a great deal for a 250gb. i'd take that over the 160gb!

Just picked it up for $129.99+tax in store, and rebate printed out. So deal is alive in store. I don't know why I got it, as I don't really need it (goddamn RFD syndrome). If someone missed out on the deal, REALLY wants it and is willing to either pick it up or pay the shipping, I'd be willing to send it over... otherwise I think I might just return it.
[EDIT] wow, lots of PMs about selling it. But it has Firewire in it.... apologies, guys, but I think I will consider keeping it. I'm going to remove the drive from inside, sell it (should be able to get $60 - $70 for a 160GB), pop in one of my 300s from my PC and use it over Firewire. Free enclosure, I suppose. :)

If you've opened it, buy the FS one and then return it as the Compusmart product. They'll refunded you for the un-opened item, and then mail in the opened CS one with the FS rebate.

I just got the last one at downtown futureshop in Edmonton.
The price on the shelf said $129 NO REBATE.
But it rang in at $199.
So I got it for the $129 and got the cashier to take off the $10 for scanning code of practice.
And the rebate form printed out.
So $128 including tax and $70 rebate.
So if the price is still on the shelf grab it and you should be able to get the drive for $50.

I think that that is correct :) $108.99 - $93.99 = $15.00 X 10% = $1.50. So the final price would be $93.99 - $1.50 = $92.49.

Yes, regular mail is more than OK. Just make sure you have these 3:
1. UPC from the box
2. Original receipt (FS usually prints a duplicate for you anyways)
3. Of course the rebate form itself and make sure you fill in the blanks neatly.
Make a photocopy of what you send in for prove for dispute.

Btw, for those interested - we opened up the one my friend picked up, and it's a Western Digital inside, and warranty (on his, anyway) is valid till August 20, 2008 (so literally 3 years' warranty). It is NOT marked as an OEM drive (unlike drives bundled with computers), so if something happens, you can just return it to WD for a replacement. So it'd be safe to sell to someone else and just keep the enclosure.

This drive is a 2MB, but it's a combo USB/Firewire - those are a bit more expensive AFAIK.
And since Firewire has significantly lower CPU utilisation than USB, this is actually not that bad. The only problem is that the connector used to mount the HD is hardwired in place (not a ribbon cable), so just like with the PS2 network adapter, you must get a drive that fits. I was planning on putting in a Maxtor 300 into it, but I'm not 100% certain whether it will physically fit. I guess we'll see.

I got one at the FS on Taschereau blvd. The shelf price is 129. I don't think they're even aware there's a mail-in rebate, when I asked for a copy of the mail-in rebate form, CSR had to go look on the net to get one.

Hi,
Went to a Futureshop in D Anjou in Montreal around 11:30AM. Thought it would be too late. Correction not made yet. $129.99 label on the shelf and at the cashier. But the duplicate receipt and MIR was not printed by the cashier. Asked for a copy of the MIR at CS. Since Futureshop is not giving us the rebate, I presume it will be accepted by the HD company in CA. This scenario reminds me of the Benq 1620 fiasco where B & M FSs were giving an instant rebate and online one had to send a MIR form. I feel we will be seeing a few of these similar situations in the future.

Not necessarily. The physical placement of the IDE 40-pin connector is SLIGHTLY different on various drives. For instance, a Seagate doesn't fit into my PS2 network adapter, while a Maxtor fits fine.

Yeap, some are thinner but they will not go bigger.
Drives aren't thinner. There was one Seagate model line which was half of 3.5" height (I'm not talking 2.5" here, though - 3.5" form factor, but half height), but they only made up to 4GB drives if I'm not mistaken. Since then, I don't believe anybody has made half-height 3.5" drives, so they're all the same physical volume. Just connector placement is slightly different.

Not necessarily. The physical placement of the IDE 40-pin connector is SLIGHTLY different on various drives. For instance, a Seagate doesn't fit into my PS2 network adapter, while a Maxtor fits fine.
I see, so if you get a 300GB WD then should be fine

Drives aren't thinner. There was one Seagate model line which was half of 3.5" height (I'm not talking 2.5" here, though - 3.5" form factor, but half height), but they only made up to 4GB drives if I'm not mistaken. Since then, I don't believe anybody has made half-height 3.5" drives, so they're all the same physical volume. Just connector placement is slightly different.
40GB Maxtors drives still 3.5" but slim

Yep, since they use the same casing.
Then again ..... I've heard that some external enclosures don't support drives over a certain size limit. I don't know why, it shouldn't matter, theoretically - but apparently, some people had a problem with that. So YMMV. The enclosure I read this about worked fine with a 300GB, but did not with a 400GB. It was a ByteCC enclosure, so this one might not have that issue - no clue.

It refers to the feeling of release, similar to a sexual climax, that a CSR experiences when he catches an RFD post and cancels all orders that were trying to order it.

Hi,
It is much easier to order online than to physically go out to the store and pick it up. Online FS has time to correct their errors whereas once you leave the store, they will not run after you and ask you to return the merchandise. I understand that not everyone has the luxury of not working full time from Mon-Fri., but if you want to snatch up deals like this, the early bird gets the worm.

Got mine in store at Markham & 14th at around 10:30 in the morning. The rep there was excellent he didn't even ask to see my printout of the web price. He also pointed out they had 6 media keyboards for $9.99 - $15 MIR. I didn't take em as I already have one and I'm sick of having tonnes of keyboards around.
He also gave me a free 3 month rogers internet signup (no contract + starter kit free) no contract! That's awesome considering I'm moving to a new house early next month! 3 free months free no contract! Sweet!
In any case, my 160gb unit says USB on the box. But inside it's also got 2 firewire ports. Wow! Once again awesome deal!
BTW on my way out I saw another RFD'er asking me if I got the deal on the drive, I pointed him to go to that rep!

If it's the same HD specs and only the one firewire device, with current HD specs (eg the current 7200 rpm variety) you probably won't notice a huge difference but external would be slower
The difference would become more noticable as HDs become faster or more firewire devices were in use (the firewire subsystem is already the bottleneck)
Same idea as USB but USB is already more noticeable (USB is slower than firewire)

Anything external is guaranteed to be slower. However, it's "fast enough" for most things; I wouldn't boot your system off it or use it as primary storage (apps, etc) - but it's definitely good enough for downloads, MP3s, etc. Firewire is better than USB because it has a lower % CPU utilisation.

I guess it would be much better for me to buy an internal HD then since I still have one slot left for a HD.

I just got back from FS. Plus I noticed my online has been cancelled. When I was in FS just two hours earlier I went to purchase the drive with printout in hand. Of course, they checked the web and found the price had changed back. I assured them that this morning it was as advertised and they called the website. After 20 minutes they are told it was a price error, yadda, yadda, yadda. So, I explain very nicely how I came into the store because of the print out and I feel almost like a bait and switch target. Quickly explaining I'm sure it's not their fault, but . . . I also explain about getting my son ready and coming by bus, yadda, yadda, yaddda. So the CSR supervisor calls another manager and explains . . . Gets off the phone and says sure, we can do that for you :) .
Now, if only I can argue with the website and get my order reinstated I'd be golden.

The correct price for this product should have been $249.99 – a $50 instant rebate - a $70 mail-in rebate = for a net price $129.99 after rebates.
As explained in our Web Site Use Agreement, futureshop.ca strives to provide accurate and up-to-date information. However, as maintenance of our website is a human process, errors do occur. After examining this situation, we regret to inform you that FUTURESHOP.ca will not be fulfilling your recent order for the AcomData 160GB 3.5" Push Button Hard Drive (E50) - 10063479.
FUTURESHOP.ca would like to offer you a $5 eCertificate towards your next purchase of over $30 on Futureshop.ca for any inconvenience this may have caused you. Your eCertificate will be valid until September 15th, 2005. Please note that the e-certificate cannot be used towards gift card purchases.
Your eCertificate Code is: XXXXXXXX
To redeem it, you simply login to your account and enter your code inside the shopping cart when you proceed to check out. If you have any questions regarding the redemption of e-certificates, please refer to our online Information Centre, or Click Here
We would like to recommend that you replace your order for this product with the $5 eCertificate as our current sale price of, $249.99 – a $50 instant rebate - a $70 mail-in rebate = for a net price $129.99 after rebates, for the AcomData 160GB 3.5" Push Button Hard Drive (E50) – 10063479 will be valid until Thursday September 1st, 2005.
We at FUTURESHOP.ca appreciate you taking full advantage of our web store opportunities and are working hard to prevent any issues similar to this matter in the future.
Please accept our sincerest apologies for any inconvenience this matter may have caused you.
We thank you for shopping at FUTURESHOP.ca and hope to serve you again in the near future.
Sincerely,

Wasn't the consumer protection law recently revised to cover online stores?
If someone knows where to get the information, please post it.
With all the price "errors" I am starting to wonder if it isn't some type of "bait'n switch". It sure does get a large group of people suddenly focused on a product and I wonder how many of them fall for the "switch" as stated in their e-mail:
"We would like to recommend that you replace your order for this product with the $5 eCertificate as our current sale price of, $249.99 – a $50 instant rebate - a $70 mail-in rebate = for a net price $129.99 after rebates, for the AcomData 160GB 3.5" Push Button Hard Drive (E50) – 10063479 will be valid until Thursday September 1st, 2005."
They have effectively taken a 129.99 - 70.00 rebate product gotten a lot of exposure and switched it with a 199.99 - 70.00 rebate product. Plus to make you feel like you are getting a "deal" they add a token product to grease the customer (5 instant rebate).

True, but it has no relevance to them beating competior's prices by 10% of the difference
Its 110% of the difference, not 10%. Here is their reply to my email:
Dear *****:
Thank you for your e-mail.
I have looked into this for you and the drive was a misprinted price on
the website and has now been corrected. (Stating the obvious here)
If you are applying for a price protection and the difference in price is
$22.50 you would get a discount of $24.75 applied to our price.
We would like to thank you for shopping at futureshop.ca. Should you have
further questions or comments, please do not hesitate to contact us at

Okay to put this into real simple math for you.
Staples Price : $50.00
FutureShop : $72.50
Difference in price: 22.50
Discount of 24.75 from Futureshop's Price
72.50 - 24.75 = $47.75
They beat Staples price by $2.25, which is 10% of the difference.
Which is what everyone has been trying to say.
110% of the difference subtracted from Futureshop's price, just like your note below said.
So it doesn't look like it is the staff that doesn't understand the policy.
Its 110% of the difference, not 10%. Here is their reply to my email:

Everyone that had their order canceled by futureshop should write in a formal complaint letter as outlined by the Ministry of Goverment Services. http://www.cbs.gov.on.ca/mcbs/english/contact_us.htm#complaintletter
I'm sure its pointless since futureshop has a posted online policy that they can correct "accidental" errors, but it can' hurt.

Going way back to what you first posted:
Compusmart has on for $93.99. FS price is $108.99
$108.99 - (108.99-93.99) x 1.10 = $92.49
which is the same as
$93.99 - (108.99-93.99) x 10% = $92.49 as I originally wrote
I still don't know how $1.50 off the lower price (ie $93.99 - 1.50 = $92.49) is anything different than you should have expected.

This is not BS, I also learn about this in my law class. Please do not make a mockery of the laws in Canada. Even if what is stated in the ad is completely bogus, it's only an invitation to offers, you are the one who is making an offer, and it is up to FS to either accept or not accept the offer.

To the OP - great post - thanks for the info!
To the lucky ones that got the deal at the store - way to go. If you got a bunch (one poster said he got 4!), why not share with some of your fellow RFDers who missed out - you don't need to make a huge profit on EVERY one!
To the many that ordered online and got cancelled - good luck with that. This is far from the first and certainly far from the last time this will happen. If some RFDer here has the $$$ to start legal action - I say give it a try. I've been burned more than once and I've come to accept that as long as it takes several hours for these online retailers to process their orders, we have to expect that the orders will be caught and cancelled.
I'll stay tuned..

I think it is only fair that FS should divulge how many orders were cancelled. A mass letter campaign could be tried by contacting Acomdata suggesting that they were given a bad name by a faulty sales pitch from FS. Who knows, Acomdata might be kind enough to give those with proof of cancellation a voucher as well for future purchase of one of their products, ( but not from FS?).

the second email is nothing but billing verification, only when consideration (goods exchanged for money) is provided is when a contract is established.
also, there must be clear "intent to establish legal relationship" to produce an enforceable contract. by receiving a letter of clarification afterwards clearly outlining their intentions, a contract was never established. There is no contract formed no matter how you look at it.

Not for online transactions.
The contract is completed when confirmation of acceptance is communicated to the offeror. Until that time, the offer may be withdrawn. In face-to-face transactions, acceptance may be communicated instantly by receiving payment and handing over the goods.

Just a point. Since the stores were scanning the item at $129.99 (no haggling required) and some said the drives were posted at the price in store, then wouldn't be discrimentory to say people shopping on-line were not allowed to purchase at the same price as people in the store?
The "resaonable man" might say that in-store shopping should be more expensive as you have the overhead of the store. This situation is the exact opposite, so it is NOT resonable to allow in-store purchases (without haggling) and dis-allow on-line purchases!
Just a thought.
Thanks.

The clerks had tucked them away deep on the bottom shelf...no price tag or nothing. She took two and I took the last one. We required the manager, and he simply said "Hey, we have to respect the lowest price avertised, do it for her, and him too" (I love the Quebec Consumer protection laws).

It is YOU who does not get it. I acknowledge that the advertisement is an invitation, and that I am making an offer to purchase, but I maintain that their second email is an acceptance of that offer, hence a contract. WOW! How can you not get this???
The issue isn't whether the advertisement is an invitation. The issue is whether they accepted our offers to purchase or not. I maintain that the email which states that they have successfully processed the order constitutes an acceptance of the offer. Of course, you may disagree, but this is the legal issue, not the straw man issue you raise whether an advertisement is an invitation.
It our particular situation, there is a grey area. Usually, processing the order and charging the credit card occur simultaneously, but since the drives were out of stock, our orders were successfully processed but our credit cards were not charged. So the question is, when is the deal sealed? When is a contract established? (A) Upon successful processing of the order or (B) upon the charging of the credit card?

Contract Formation
Generally speaking, there are no formal requirements under Canadian law for the formation of a contract. Contracts may be formed by oral or written agreement or by the conduct of the parties. However, some statutes and regulations impose specific writing or signature requirements for the contract to be enforceable in a court of law.
Electronic commerce presents new challenges to existing contract principles in several areas. Issues such as offer and acceptance, the location of the contract, and implied terms and conditions offer new scope for disputes between contracting parties. As yet, there is little or no case law in Canada with respect to electronic contracts and it is impossible to know how the courts will resolve these issues. However, one may make some educated guesses on the strength of past responses to new technology such as the public postal service, telegraph, telex and facsimiles.
Offer and Acceptance
In Canada, a contract is formed through the exchange between the parties to the contract of an offer and an acceptance of that offer1. In electronic transactions, it may not always be clear which party is making an offer, in the contract sense, and which one is accepting. For example, an advertisement is generally not viewed as an offer to sell but as an "invitation to treat" or a willingness to consider offers to purchase. The prospective buyer makes the offer when he or she offers to buy the advertised goods or services. This may be done in person, for example in a retail store, or remotely, when a person fills in the order form in a mail-order catalogue. Or it may be made when someone enters their name in an electronic order form on a computer network.
In each of those instances, [(A) - my insertion] acceptance of the offer occurs when the retail merchant, mail-order house or on-line service provider receives the offer and processes the order. [(b) - my insertion] If the customer is offering to pay with a credit card, for example, acceptance of the offer may be given only when the credit card company has authorized the transaction.
The contract is completed when confirmation of acceptance is communicated to the offeror. Until that time, the offer may be withdrawn. In face-to-face transactions, acceptance may be communicated instantly by receiving payment and handing over the goods.
However, various forms of communication have given rise to problems determining when and where acceptance has been communicated to the offering party. The rules governing communication of acceptance, first adopted in the United Kingdom, have been widely followed in Canada over the years. The general rule is that the contract is not complete until the acceptance has been received by the offeror. The principle exception to the rule arises in the postal acceptance or "mailbox" cases, in which acceptance has been held to be complete upon posting a letter or dispatching a telegram, even if the letter or telegram is delayed or lost2. However, the courts have held that with modern forms of instantaneous communication, the rationale behind the "mailbox rule" does not apply. Therefore, acceptance by telephone, telex and facsimile is effective only when it is received.3
According to one view, the mailbox rule is a limited exception, based on the practical limitations and delays inherent in conducting commercial transactions by mail. It was introduced to accommodate the new postal and telegraph technologies of the 19th century and should not be extended further than necessary. However, the view has also been expressed that the general rule requiring actual receipt of notice of acceptance should apply where the means of communication is instantaneous and bi-directional (for example, by telephone), but that the postal exception should apply where communication is time-delayed and unidirectional (which would include facsimile and telex, as well as mail and telegram).4
If this understanding of the rationale behind the rule is correct, Canadian courts may apply the general rule to situations where acceptance is communicated instantaneously, such as Internet transactions, but adopt the mailbox rule, perhaps in some modified form to adapt it to the new technology, where acceptance is communicated by electronic mail or via a third-party EDI network.
Issues may also arise when use of electronic commerce results in situations where acceptance is communicated and received by a computer, rather than a person. When the exchange of messages making up the offer and acceptance have been made entirely automatically, have the parties really agreed? Who bears the risk of communication errors? These questions have not yet been answered in Canada.
The United States case Corinthian Pharmaceutical Systems Inc. v. Lederle Laboratories5 serves as a guide. In that case, an "order tracking number" issued by an automated telephone ordering system was found to be merely an acknowledgment of the order, rather than an acceptance which formed a binding contract. Applying the same reasoning to common electronic commerce practices, this could mean that a computer-generated message acknowledging receipt of an electronic order may not be sufficient to create a binding contract. The purpose of the message may be solely to confirm receipt of the order. It does not necessarily signify acceptance.
In some circumstances, the requirement for communication of acceptance may be waived, expressly or by implication. For example, conduct such as delivery of goods or services or payment of money have been held to constitute acceptance. Similarly, a course of dealing between the parties over time may lead one party to reasonably expect that an order has been accepted unless it is expressly rejected. Electronic trading partner agreements typically contain provisions that sending a specific message -- or the failure to send a specific message within a stated period of time -- constitutes acceptance of the proposed contract.

I'm one of the lucky ones who picked a unit up at the local B&M FS. On my way home I ran out and picked up some Firewire cables. Plugged everything in and WinXP proceeds to detect the drive and starts looking for drivers... and now I get the "Cannot Install this Hardware" window.
Does anybody know where I can find drivers for the Firewire connection to the acomdata drive? Do I even need them? Perhaps I should look for the CD in the box, but I figured it'd be pretty much plug-and-play.
Thanks!

I emailed FS to complain that my order was cancelled.
They gave me a tracking number and requested that I quote the number for all future correspondence to this matter.
Does this mean that I'm any closer to having them process my order or is this just to simply make things easier for them to track which BS reasons they have given me so far!!
The other day they screwed up the pricing on the keyboards, Were any of those orders cancelled? My keyboard happens to be sitting in release status.
So they cancel orders for one error but not the other??

(A) Upon successful processing of the order or (B) upon the charging of the credit card?

nacho, it is not the acknowledgement of receipt of the order, but the processing of the order that is relevant. Erdle claims that the merchant has accepted the offer when he has received the order and processed it.

Well I used my $5 off $30 coupon. I purchased the SMC7004VBR router for $57.49 after tax - $50 mail-in rebate. Next week when I'm near FS I'll repurchase in store using my GC. That'll bring my price down to $45.99 after tax - $50 mail-in rebate.
Since I was able to buy it instore anyway. I've received:
One external drive and one router for $45.58 after tax after GC.

Even if it IS "an invitation to an offer". Their confirmation that the item will ship when available could be considered the "acceptance or our offer in response to their offer"
Sorry, but I don't believe there is such a thing as "an invitation to an offer"
It IS an offer to sell
We are accepting that offer.
Using their logic, who says my order is an offer that they can accept or not, maybe I'm just inviting them to make me an offer

Ya, I took a few courses in university, but I'm certainly no lawyer. I know for a fact that we cannot hold FS accountable for what happened. So all this talk about taking civil action against FS is really BS.
My order still says Released, and I never got the $5 ecertificate letter. I don't really care if it doesn't go through, I guess I'll have to think that it's better to keep the $150 in my wallet instead. Oh well............

Technically, the legal term is "invitation to treat", which essentially means an advertisement is an invitation by the seller to a prospective buyer to make an offer. It's well established in law that an invitation to treat is not an offer and so a person responding to it cannot be said to be accepting an offer.
To my mind, the argument that the confirmation e-mail is evidence of the acceptance by Futureshop of a would-be buyer's offer is not without merit but I don't think it is conclusive. Moreover, whether a contract is enforceable is not wholly dependent on offer and acceptance. Other contractual principles may come into play, like mistake.

i really don't understand why some people have to make such a big deal out of it...its like, you saw an impossible deal, you knew the pricing was an error, you tried to take advantage of it and then fs discovered the fault. so they COMPENSATE you with $5 e-coupon...in the end, all you lost was an attempt to take advantage of a situation but you gained a free $5 bux...
you didn't lose any money! you didn't lose any product....all you lost was an opportunity to TAKE ADVANTAGE of someone else....and you're complaining??
everyone makes mistakes...its like a bank. if they gave you extra money, i think they have like 20 or some odd days to take it back...so if a company makes a HUMAN ERROR, they should also have the opportunity to correct that situation....and in the end, they already lost $$ selling those at the B&M stores and giving out all those $5...
so....too bad if you missed out on cheating someone while surfing the net
and good for you if you got out of your chair, drove to a fs and picked one up.

$129.99 sale price for a $249.99 isn't an impossible deal. They had that Microsoft Keyboard/mouse combo 3.0 deal for $39.99 from $120, thats 66% off, which is even more then the roughly 50% off that the acomdata drive would be, before the MIR from the manufacturer.
I'm still going to keep complaining until either they honour the price of the order I submitted, or until I get bored of it. And since I doubt they would honour the deal under any possible circumstances, I will probably get bored of it eventually. Then again, I was REALLY looking forward to that extra HD space....

Final word for anybody interested: it works fine with 300GB drives. I took out the WD, put in a Maxtor, and it works beautifully. A note: the IDE connector doesn't fit 100% (should fit all WDs, but looks like it's a bit wide for a Maxtor), so take an Xacto knife and file off about 1mm from the OUTER edge of the connector (it fits fine on the inner edge) - and bang, you got you a bigger removable drive.
Too bad it can't be powered ONLY by Firewire, though - that'd be sweet :(

Do you have it running with Firewire now? Are you using Win XP? Any probs during installation (driver issues)? What speeds do you achieve when transferring files?
It took me over a day (30+ hours) to backup (transfer + verify) 110GB worth of files using the software.
My speeds started at over 400 MB/min and then dropped to ~80 MB/min using USB2.0, which is why I want to get the firewire working.

It works fine using Firewire. The speeds I got, with write caching off, is ~24MB/sec using USB 2.0, and ~21MB/sec using Firewire (your result of 80MB/min is probably because you don't have USB 2.0 --- 80MB/min is about the right amount for USB 1.1). Main difference between USB 2.0 and Firewire: USB 2.0 -> ~36% CPU utilization (spikes to 50% sometimes), Firewire - steady 8-10%. Note: these speeds were achieved using the 160GB drive. Using a 300GB Maxtor with 16MB cache, I was able to get 24.5MB/sec using the Firewire port.
No driver issues, as long as you install the stupid push button manager.
I don't use it for backups - I ripped out the internal 160GB, replaced it with one of the 300s in my system and put it external so that I only have 2 drives inside my case (and have a free IDE port). Now I can return to a mid-tower case and have proper cooling (having 3 300GB HDs isn't cooling-friendly....)

Damnit, I really want one of these drives now. If I had access to a vehicle at the time, I would have driven to the store. Unfortunatly I am a poor university student and only have limited access to a parent's vehicle when its not in use.
After calling them on the phone and emailing them a couple of times, I had decided to give up. Now I think I will still send a physical letter of complaint before I give up on this. If it was advertised on the shelf as $59.99 after rebates, then its a lot more then a simple error on the website like they originally claimed.

Did anyone order 2 and recevied both drive? Maybe I shouldn't have been that greedy.

Any one know of any good deals on firewire cables?? Any comments are appreciated.
If you are going to get anything during NCIX flat 5.99 shipping (ends today), then you could also add a cable for relatively good price. Search there using "1394 cable" for other various more expensive ones, 6p interface on drive, depends on what you are connected to on other end for 4p (laptop) or 6p (most PCs).
$7 or $8, for 2m or 3m cable. Might even be worth it alone compared to other places with the shipping and no PST outside BC.
http://www.ncix.com/products/index.php?sku=22292C&vpn=1394MM-0206A&manufacture=BAFO%20TECHNOLOGIES
I got the drive as well in-store on Friday AM for $129 (scanned up that way) when I thought it might be warm deal (didn't really want USB2), but when I found out it had firewire, no way I am giving this up. I have a 4p-6p 1394 cable now, but I'm going to get a 6p-6p as well.

The rear panel, the one near the USB/Firewire ports, is GLUED on. Meaning you have to gently pry it away, and below it, you will find screws to take the thing apart.
I just left the metal panel off after that. It really adds no features whatsoever and is annoying if you ever want to change the drive inside.

I'm argueing with FS that they should have honored my on-line order. I think if I provide proof that they processed orders at 129.99 before the rebate I still might be able to get in on this deal.
I let you know if this works.
Thanks!!

I'm still emailing them about this. I can't even afford the drive now if I wanted it, but I'm just incredibly pissed off about all the canned emails. I think they even tried to just get me to stop emailing by saying the email had been forwarded to the appropriate dpartment. I waited like 4 days without any response and when I finally asked which department they were refering to, I got another canned response saying they reserve the right to do as they please.
They have never answered any questions or concerns, either though email or on the phone. I am almost certain they never read the emails sent to them. They are the worst customer service department I have ever had to deal with. Then again, I haven't dealt with customer service for many other stores so I guess they could all be this useless for all I know.
Oh well, I will just continue to send short and polite complaint emails.

You might want to call them about it. I called and the person took my name and number and said she'll forward my inquiry and get back to me. That night at like 9 or 10pm I got a call back from them telling me the day it was shipping out and that it would take 3-10 days to get here.

same thing they said to me when i called last week. csr told me they have a cheque for me and it'll be sent out next day. she said i'll receive it in about 8 days.
keep in mind when i made this call it is week 13 and a half after i had sent in the rebate.
in total, i made 2 calls and sent 1 email:
1st call on week 9 - nothing shows up in their system...no record of my mir, was told to calll back in 2 weeks.
read the messages here about others getting their cheques sent out, figured company was finally sending it out.
week 11 - emailed. i know i should have called since mir said to call. but someone mentioned they responded to email i emailed them. figured this is best since the cheque is most likely be here any day now if they're sending out to people on this board. no response to email.
week 13 1/2 - my last call which i outlined above.
for those who didn't get their mir, call them.
they're suppose to send mir 8 weeks after receiving a qualifying rebate, so what the hell were they waiting for.

I called 3 times and found this out in the last conversation with the rep:
my cheque was issued on Dec 29th and post-marked on Jan 3, but the check was returned on Jan 7. Which, if true, means that the cheque never really left the sorting facility. I asked the rep whether Canada was included in the address and she said no, just Toronto, ON and the postal code. I suspect the postal worker had no idea how to interpret the address without telling them that it's Canadian. They will re-mail my rebate again and I hope to receive it soon...
I recommend people to call Acomdata: 1-800-470-4495-1 (english)-2 (rebate center). As whether they issued one for you and whether they mailed it already. Then, if you still haven't received them, ask them to check their returned cheque list. At least their CS is working and I was able to talk to a human rep each time.
Bottom line: this is the last time I will ever purchase anything with mail-in rebates.
