I bought a 2nd gen 4gig IPOD mini in pink on March 9th ( I have the receipt as a proof, so theres still almost A YEAR of warranty). It's taken out of the box, I've also used it for 2 days, but the ipod is sitll in its original wrap and everything is BRAND NEW - no scratches, nothing.
I'm looking for trades with other lower end mp3 players (at least 512 MB) that have been used for less than 3 months. Of course, you'd have to add cash accordingly.
OR I'll sell it for $225 FIRM. or $230 PLUS an IPOD SOCK - you save $5 on the SOCk!

Why not just return it? Can you not return it after you've opened the packaging? That sort of sucks then...

YES IT IS SECOND GEN.
You can distinguish second from first generation mini's simply by looking at the clickwheel.....
Second generation ones have matching colours on the "menu" or "fast forward" buttons with the ipod colour, while first generations one don't....
