Default 3 tickets .. car ppl .. must read, not about tickets

I need help for a friend who got 3 tickets for no real reason. Each ticket is worth $110!!!! (i think this cop was being stupid and decided to charge my friend with everything possible)

unsafe lane change (had signal on and was waiting to get to the left turning lane from the right lane, did it safely)
exhauste (loud, but EVERYONE who sups up cars have em, they are said to be street legal)
not carryin plate portion of ownership (not sure what the BS was about)

Any help would be appreciated, he cant afford $330 for nothing at all

LOL, some RFDers feel it to be more then to simply give advice, they feel that they need to criticise my friend and (lol) my intelligence? .. you know, because intelligence has EVERYTHING to do with helping someone out ...

Flame02, tell your friend not be scared...lol. The cops don't do **** and they have nothing else to do but pick on people with nice cars.

Just go to the courtdate and usually the cops just forget and you can do your thang. Say to the judge how weird these things are. Say that your friend signalled and changed safely like anyone else. They have no basis or proof.

For your exhasut, its always legal. Get your friend to print out the manufactures specs about his muffler. Again cops are just BS again.

Last one I dunno about about that..lol just BS again I suppose.

Don't be afraid. Act like your sorry and be on your way out with either a lowered fine, no fine, just try to get it lowered or done with.

These cops should be getting the robbers, criminals instead of picking on people with nice cars. Again they just want money. THEY HAVE NO BASIS for what they did.

Cops do have somewhat of a negative bias toward street racers...I've seen it happen sometimes.

bwhaha...first time with cop and knows what they're doing in the same sentence.. how would they know what exhaust are legal or not?

what part of the HTA would a modified/after market exhaust/muffler violate?

if it passes smog its legal. and the cops probably dont even know what smog is since the like to idle in from of timmys for their shifts

Highway Traffic Act, R.S.O. 1990, CHAPTER H.8

Muffler

75. (1) Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and excessive smoke, and no person shall use a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon a motor vehicle or motor assisted bicycle. R.S.O. 1990, c. H.8, s. 75 (1).

Personally, I hate those cars that make excessive noise and don't sympathize with your friend as I live on a main street and have to hear these cars constantly droning along. What's the purpose of putting an performance exhaust system on a car with no performance? All they do is make excessive noise and I believe your friend falls within Section 75(1).

btw: If this guy gets found guilty on all three charges I guess we can expect the follow-up posts:

Thanks there neighbour, i love the way you gudge a book by its cover! If u need to know my friend did NOT put this on, it was the previous owner and now hes stuck with all this. Its not that loud, its just when the cop pulled him over, he noticed the size of it back there, not the noise value. It gets very loud at 4k + RPMS, my friend does MAX 3k on city streets.

btw, if ure not going to help this serious situation, i dont want to see any of you bs!

also would <a href=../autolink/redirectpage.php?linkid=24 target=_blank>canadian tire</a> sell exhausts that are illigal?

The prosecutor will throw at least one ticket out. Make sure that ticket is the unsafe lane change. In exchange, the victim will probably have to plead guilty to something so I'll take the plate portion of ownership ********.

The loud exhaust I don't believe is a moving violation so you might be ok insurance wise. see if you can get both tickets thrown out for pleading guilty to the ownership bs.

I am not pre-Judging this case BUT if those are the defences that your friend is going to submit to the Justice of the Peace in Provincial Court, your friend is at risk for the following reasons:

1. The fact that someone else put it on the car is irrelevant to the fact that your buddy was driving the car at the time;

2. Excessive noise is not defined in the HTA with an objective decibel rating therefore the legal test would have some subjective and objective factors to be considered by the learned Justice of the Peace. Your friend may want to call expert evidence on the subject (i.e. an expert on noise pollution who would testify under oath that your friend's muffler system is in good working order and does an acceptable job at keeping the noise of your buddy's vehicle in line with socially acceptable standards (which is the policy objective of the act). Why don't you look up the Government Hansards to confirm that was indeed the policy objective (although not legally binding it is persuasive) The Justice of the Peace is probably as annoyed about these things as I am and without any evidence produced by YOUR BUDDY that the muffler system did not create excessive noise, your friend faces considerable risk of being found guilty; and

3. The fact that <a href=../autolink/redirectpage.php?linkid=24 target=_blank>Canadian Tire</a> sells these things is also irrelevant, I am sure there is a disclaimer on the package that states maybe illegal in some states/provinces, off-road use etc. etc. It is up to the user to ensure that it complies with all laws.
