Very simple way to find out. Plug it in and check the SMART power on hours value. You can use a tool like CrystalDiskInfo:

Though obviously I'm with you folks here in that there's no way of knowing that without the drive sealed in its original box. If you're actually upset with the drive, I suggest you refund it. Personally, having a drive sent to me like that would be unacceptable.
